A Procuradoria Geral do Estado (PGE) ingressou, na última sexta-feira (12), com pedido de suspensão da decisão proferida pela 6ª Vara da Fazenda Pública da comarca de Salvador, que determinou a retomada das aulas no sistema de educação, público e privado, no estado da Bahia, até o dia 01/03/2021.
No pedido, dirigido ao presidente do Tribunal de Justiça, a PGE sustenta que a decisão é manifestamente ilegítima, por não ter observado as razões científicas que fundamentam a suspensão da atividade letiva. Além disso, foi demonstrado que a decisão impõe grave ofensa à saúde e ordem públicas, especialmente porque determina o retorno das aulas no momento em que se constata aumento vertiginoso de contaminação e óbitos em razão da Covid-19.
Em sua argumentação, a Procuradoria Geral do Estado reconhece que “o desejo de todos, na Bahia, é que os alunos retornem às suas atividades presenciais, ao convívio e ao amparo das escolas. Hoje, entretanto, esse retorno é tecnicamente inviável, e acarretará uma crescente, exponencial e dramática contaminação do vírus e expansão da Covid-19 no estado”.
Ressalta também que, por esta razão, é de fundamental importância o isolamento social, já que o estado apresentou um crescimento, nos últimos cinco dias, de 1,99%, e encontra-se em terceiro lugar com maior número de casos no país, conforme os dados do Painel CONASS- Conselho Nacional de Secretários de Saúde. E alerta ainda que, informações técnico-científicas de órgãos estaduais da saúde confirmam a chegada de uma nova cepa do vírus, muito mais infecciosa, inclusive, sobre as crianças.
