A determinação do Ministério dos Povos Indígenas de anulação da Instrução Normativa nº 09, emitida em 16 de abril de 2020 pela então Fundação Nacional do Índio (Funai), autorizando a comercialização e exploração de terras invadidas dentro de territórios ainda não homologados, abre precedente para a anulação de certificação concedida a fazendeiros durante o governo Jair Bolsonaro.
Pelo menos 239 hectares foram cadastrados no Sistema de Gestão Fundiária (Sigef) do Governo Federal em áreas que ainda estão sob estudo e são passíveis de demarcação. Os territórios ainda não homologados constituem a maioria das terras habitadas por povos isolados, segundo ofício assinado pela ministra Sônia Guajajara.
“No Brasil existem ainda 114 registros de povos isolados e de recente contato. Destes, apenas 28 são confirmados de acordo com a metodologia do órgão indigenista, em 17 Terras Indígenas e 3 áreas com Restrição de Uso. O restante, 86 registros, estão em fase de qualificação”, afirma o documento datado do dia 24.01.
A instrução normativa Nº 09 foi contestada pelo Ministério Público Federal (MPF) e teve liminar concedida em favor dos povos indígenas em pelo menos sete municípios do Pará: Belém Altamira, Castanhal, Itaituba, Redenção, Santarém e Tucuruí. Em Altamira, Castanhal, Santarém e Tucuruí as liminares foram confirmadas em sentenças.
Em 28 de abril de 2020, o MPF emitiu a recomendação de Nº 13/2020 ao Presidente da Funai à época, o policial Marcelo Augusto Xavier da Silva, pela anulação imediata da IN nº 09/2020, “por patente inconstitucionalidade, inconvencionalidade e ilegalidade”. O documento foi assinado por 49 procuradores da República de 23 estados.
Pela IN nº09/2020, as permissões da emissão de Declaração de Reconhecimento de Limites (DRL) em favor das terras ainda não demarcadas ganharam caráter de posse ao autorizar a comercialização e exploração das mesmas. Anteriormente, o documento representava uma certificação de que a propriedade privada não havia invadido terra indígena.
