Em afronta a garantia prevista na Constituição Federal, que estabelece a proteção às pessoas com deficiência, quando no Estatuto da Pessoa com Deficiência, que prevê o dever do Estado em assegurar, com prioridade, a efetivação dos direitos referentes à Vida, à Educação, ao Transporte e à Acessibilidade, entre outros, A Câmara Municipal de Caculé, na Sessão Ordinária da segunda-feira, 16 de outubro, por maioria de votos (seis a quatro e uma abstenção), rejeitou Projeto de Lei 06 de 04 de agosto de 2023, que criava “transporte para crianças com Transtorno do Espectro Autista e/ou crianças com Deficiência Cerebral, no âmbito do município de Caculé”.
A maioria dos vereadores aprovou o Parecer emitido pela Comissão Temática Permanente de Constituição e Justiça, que por dois votos [vereadores Alessandro Luís Figueiredo de Jesus (PSB) e Salvador José Alves (PSB)] contra um [vereador Anderson dos Santos Ribeiro (UB)], recomendou a reprovação do Projeto de Lei 04/2023, argumentando que a proposta era inconstitucional, reforçando que, “embora salutar no sentido de buscar condições de tratamento aos portadores de TEA fora de seu domicílio, por outro lado, busca exclusividade e obrigatoriedade do transporte, ferindo Princípios da Administrativos Pública, tais como o da Igualdade e da Impessoalidade, visto que não só os portadores de TEA carecem do transporte, mas sim todos os enfermos em situação urgente e grave que não podem ser atendidos ou tratados em seu domicílio de origem, ou seja, em Caculé”. E finalizou “opinamos pela sua inconstitucionalidade, vez o mesmo propõe uma quebra no equilíbrio entre direitos dos portadores de TEA em detrimento de todos os outros enfermos em situação de gravidade”.
