Companhia de Desenvolvimento dos Vales do São Francisco e do Parnaíba (Codevasf) passam a contar com a inclusão de cláusula anticorrupção. O objetivo é aperfeiçoar os mecanismos de governança e integridade, visando prevenir e combater atos lesivos contra a administração pública, garantindo a probidade e a transparência nas relações contratuais da empresa.
A medida, que segue recomendação do sistema e-Prevenção do Tribunal de Contas da União (TCU), passa a valer a partir do segundo semestre deste ano, sendo inserida em todos os contratos, convênios e instrumentos congêneres a serem celebrados pela Companhia.
“A inclusão da cláusula em nossos contratos fortalece ainda mais a estrutura de governança e integridade da Codevasf. Com essa medida a Companhia reafirma seu compromisso com a prevenção e o combate a atos lesivos à administração pública. É uma importante iniciativa de proteção de processos, que mantém a Codevasf alinhada a elevados padrões de ética e integridade”, avalia Lucas Felipe de Oliveira, diretor-presidente da Codevasf.
De acordo com a Secretaria de Licitações e Contratos da Codevasf, o primeiro edital contendo a minuta de contrato com a nova cláusula já foi publicado e está disponível no site da empresa https://editais2025.codevasf.gov.br/licitacoes/sede-brasilia-df/licitacoes-lei-13-303-2016/editais-publicados-em-2025/edital-no-90005-2025/ .
“Essa nova cláusula é um reflexo do nosso empenho em atuar em total conformidade com a legislação brasileira anticorrupção, como a Lei nº 12.846. Ao inseri-la em todos os nossos instrumentos contratuais, estamos não apenas seguindo as melhores práticas, mas também oferecendo mais segurança e confiança aos nossos parceiros e à sociedade”, avalia Renato Isacksson, chefe da Secretaria de Licitações e Contratos da Codevasf.
A cláusula anticorrupção segue os preceitos legais instituídos pelo ordenamento jurídico brasileiro no que tange ao combate à corrupção, em especial a Lei nº 12.846 (Lei Anticorrupção), de 1º de agosto de 2013, e o Decreto nº 11.129/2022, de 11 de julho de 2022.
Segundo a chefe da Secretaria de Integridade da Codevasf, Renila Bragagnoli, a inclusão da cláusula atende ao Plano de Integridade e a Política de Combate à Fraude e Corrupção da Companhia, sendo uma iniciativa importante para o fortalecimento da cultura de integridade na empresa e valorização das boas práticas implementadas. “A inclusão dessa cláusula é prática recomendada pelo sistema e-Prevenção, do TCU, sendo um requisito que, uma vez atendido, eleva o grau de maturidade da empresa em questões de integridade e combate à corrupção”, explica.
Dentre os artigos da nova cláusula, está previsto que qualquer descumprimento das regras da Lei Anticorrupção e suas regulamentações, por parte do contratado, em qualquer um dos seus aspectos, poderá ensejar a instauração do Procedimento de Apuração da Responsabilidade Administrativa – PAR, além de outras sanções.
