Os Microempreendedores Individuais (MEI) poderão emitir a Nota Fiscal de Serviços Eletrônica (NFS-e) a partir do dia 1° de janeiro de 2023. O serviço estará disponível no Portal do Simples Nacional. A informação foi divulgada pelo Comitê Gestor do Simples Nacional (CGSN), por meio da Resolução CGSN nº 169, do dia 27 de julho de 2022.
A emissão da NFS-e pelo Portal do Simples Nacional valerá para serviços não submetidos à incidência do Imposto sobre Operações relativas à Circulação de Mercadorias e sobre Prestações de Serviços (ICMS), de acordo com o Simples Nacional. A partir de janeiro de 2023, o MEI poderá utilizar os seguintes dispositivos:
I – emissor de NFS-e web;
II – aplicativo para dispositivos móveis; e
III – serviço de comunicação do tipo Interface de Programação de Aplicativos (API).
É importante lembrar que a NFS-e não deve ser emitida para atividades de comercialização de mercadorias e de serviços com incidência de ICMS. A emissão de NFS-e para pessoas físicas continua facultativa.
Segundo o Sebrae, mais de 13 milhões de empreendedores poderão ser beneficiados. A NFS-e do MEI terá validade em todo o país, e será suficiente para fundamentação e constituição do crédito tributário. Além disso, dispensará certificação digital para autenticação e assinatura do documento emitido.
Para o economista Carlos Eduardo Fernandes, a emissão das NFS-e facilita processos e agiliza o trabalho do MEI, permitindo melhorias.
“Simplificando isso aumenta a produtividade da economia e melhora a arrecadação porque é uma coisa fácil, que pode ser preenchida até no próprio aparelho celular”, conclui.
A psicopedagoga Edilene Carneiro, de 54 anos, que atua como MEI em uma creche no Paranoá (DF), considera a nova forma de emissão das NFS-e mais simples e de fácil entendimento.
“Geralmente as pessoas que mexem com isso são pessoas muito novas que têm acesso e disponibilidade de mexer com computação e com essas novas tecnologias. E como é um processo bem reduzido e muito simples, qualquer um de nós consegue emitir a nota fiscal”, completa.
Em breve, os contribuintes enquadrados como MEI poderão realizar a ação por meio de um aplicativo que será disponibilizado para dispositivos móveis. A emissão será facultativa até janeiro de 2023, de maneira simplificada, com apenas 3 passos de preenchimento: CPF ou CNPJ do tomador, serviço e valor.
Após a emissão da nota pelo prestador, o programa enviará diretamente para o dispositivo móvel do tomador, que poderá visualizar todas as NFS-e recebidas.
