A violência contra a mulher no Brasil continua a ser uma questão social alarmante, mesmo com a Lei do Feminicídio, que comemora dez anos, estabelecendo, em sua atualização mais recente, que o feminicídio é um crime autônomo e hediondo. Essa legislação ampliou a definição de violência de gênero para além do âmbito doméstico, prevendo penas que variam de 20 a 40 anos. No entanto, na prática, a implementação da Lei enfrenta obstáculos significativos, como a lentidão da Justiça na concessão de Medidas Protetivas. Em 2024, por exemplo, dados oficiais revelam que apenas 3 das 75 vítimas contavam com essas Medidas, e apenas 12 haviam registrado Boletins de Ocorrência na Polícia Civil.
Além da morosidade do sistema judiciário, destaca-se o despreparo das autoridades policiais, visto que a maioria das Delegacias de Polícia Civil – apenas 7% das cidades brasileiras possuem uma Delegacia Especializada EM Atendimento da Mulher (Deam), segundo levantamento feito pela Revista AzMinas – não segue protocolos adequados para identificar e registrar feminicídios, resultando em subnotificações e na descaracterização dos crimes. Especialistas apontam também para a ineficácia das Medidas Protetivas: muitas das vítimas assassinadas não estavam sob a proteção do Estado, evidenciando falhas na prevenção.
Esse cenário dramático é exemplificado pelo caso de Edlane Luz, de 33 anos, brutalmente assassinada na manhã de sábado em Planalto. Testemunhas relatam que ela foi atropelada intencionalmente e, em seguida, esfaqueada na Rua 2 de Julho, enquanto se dirigia ao trabalho, por seu ex-companheiro, João Paulo, que fugiu após o crime.
Apesar de Edlane Luz, segundo relatos de amigos, ter registrado um Boletim de Ocorrência na Delegacia Circunscricional de Polícia Civil de Planalto e solicitado uma Medida Protetiva contra seu agressor, há indícios de que essas ações não foram efetivadas ou suficientemente eficazes para protegê-la, o que reflete as lacunas na aplicação da Lei do Feminicídio e na atuação das autoridades na defesa de mulheres em situação de risco, além das persistentes desigualdades de gênero na sociedade. O assassinato brutal da jovem evidencia a discrepância entre a legislação e sua aplicação prática, frequentemente resultando em impunidade e facilitando a continuidade da violência contra mulheres.
A morte de Edlane Luz, que chocou a comunidade, reabre o debate sobre a necessidade de uma resposta estatal mais ágil e eficaz diante de casos de violência de gênero, especialmente quando as medidas de proteção não são suficientes para prevenir tragédias.
Nas redes sociais, familiares e amigos expressaram não apenas sua indignação pela ineficácia das autoridades em responder ao risco que a jovem enfrentava, mas também reforçaram a necessidade de uma investigação ágil e de penas rigorosas para o criminoso, sublinhando a urgência de combater a impunidade e assegurar a segurança das mulheres.
