Indenização será paga em casos de criança com deficiência comprovada

Medida provisória publicada nesta quinta-feira (9) no Diário Oficial da União autoriza o pagamento, por parte do governo federal, de indenização no valor de R$ 60 mil para famílias de crianças com deficiência causada por infecção pelo vírus Zika.
“Fica instituído apoio financeiro à pessoa nascida entre 1º de janeiro de 2015 e 31 de dezembro de 2024, com deficiência decorrente de síndrome congênita causada pela infecção da genitora pelo vírus Zika durante a gestação.”
De acordo com o texto, o requerimento da indenização deverá ser feito ao Instituto Nacional do Seguro Social (INSS), sendo obrigatória a constatação da relação entre a síndrome congênita e a contaminação da mãe pelo Zika durante a gestação; e da deficiência.
A publicação cita ainda que o pagamento do valor não será considerado para fins de cálculo de renda mínima destinado à permanência da pessoa no Cadastro Único para Programas Sociais do Governo Federal (CadÚnico); à elegibilidade para o recebimento do benefício de prestação continuada; e à transferência de renda do Programa Bolsa Família.
“O apoio financeiro de que trata esta medida provisória, ressalvado o direito de opção, não é acumulável com qualquer indenização da mesma natureza concedida por decisão judicial.”
As despesas decorrentes do pagamento da indenização, segundo o texto, correrão à conta do programa orçamentário Indenizações e Pensões Especiais de Responsabilidade da União.
A medida provisória tem validade a partir do momento em que é publicada, mas precisa ser aprovada pelos plenários da Câmara dos Deputados e do Senado para se tornar lei. O prazo de vigência da MP é de até 120 dias.
Entenda
A síndrome congênita associada à infecção pelo Zika compreende um conjunto de anomalias congênitas que podem incluir alterações visuais, auditivas e neuropsicomotoras em indivíduos expostos ao vírus durante a gestação.
Tais alterações, de acordo com o Ministério da Saúde, podem variar quanto à severidade, sendo que, quanto mais cedo ocorre a infecção durante a gestação, mais graves tendem a ser os sinais e sintomas característicos da síndrome.
A principal forma de transmissão do Zika em mulheres grávidas é por meio da picada da fêmea do mosquito Aedes aegypti, mas a transmissão também pode ocorrer por meio de relação sexual com indivíduos infectados ou de transfusão sanguínea.
A síndrome foi descoberta em 2015, após alteração no padrão de ocorrência de microcefalia em bebês nascidos vivos no Brasil. À época, o evento foi considerado emergência em saúde pública de importância nacional e, posteriormente, internacional.
Algum tempo depois, constatou-se que os casos de microcefalia, que também cursavam com outras anomalias cerebrais e alterações neurológicas, estavam associados à infecção pelo Zika no período gestacional.
