O ministro da Fazenda, Fernando Haddad, irá participar nesta quarta-feira (6) de uma audiência pública na comissão mista do Congresso Nacional que analisa a Medida Provisória 1.303/2025. Entre outros pontos, a MP aumenta a tributação sobre as bets. O encontro será realizado no Senado, como parte de uma série de quatro audiências previstas para agosto.
Durante encontro em julho, o relator da comissão mista, deputado Carlos Zarattini (PT-SP), ouviu os representantes de entidades relacionadas às apostas, como a ABRAJOGO e a AIGAMING. Eles alertaram para os riscos da elevação na carga tributária, que pode inviabilizar economicamente operações legais e incentivar a fuga de apostadores para plataformas ilegais.
Segundo dados do site KTO, o futebol respondeu por quase 90% do volume movimentado em apostas esportivas no mês de junho. Já os jogos de slots representaram mais de 93% das rodadas realizadas no cassino online da empresa, destacando o interesse crescente nas duas categorias entre os apostadores no país.
A atual estrutura de taxação, segundo as casas de apostas, já soma aproximadamente 38% quando se somam os 12% de GGR (Gross Gaming Revenue) aos 25% de IRPJ e 9% de CSLL. O GGR representa a receita bruta das operadoras, ou seja, a diferença entre o total apostado e os valores pagos em prêmios. Com o novo aumento, o impacto poderá ultrapassar os 42%.
A MP 1.303/2025 foi encaminhada ao Congresso ainda em junho e propõe uma série de mudanças fiscais para compensar recuo na cobrança do IOF sobre determinados serviços. As alterações incluem a unificação da alíquota do Imposto de Renda Retido na Fonte para aplicações financeiras em 17,5%, e a inclusão de ativos antes isentos, como Letras de Crédito Imobiliário (LCI) e Fundos Imobiliários, sob uma nova alíquota de 5%.
Porém, o aumento da taxação sobre de 12% para 18% sobre o GGR (Gross Gaming Revenue) das casas de apostas vem dominando o debate, por ser ligada a outra campanha do Partido dos Trabalhadores (PT). Intitulada “Taxação BBB”, sigla que se refere a bilionários, bancos e bets, a iniciativa busca reforçar o discurso de justiça tributária promovido pelo governo Lula.
Ao mesmo tempo em que coloca como prioridade de agenda a isenção do Imposto de Renda para quem ganha até R$ 5 mil, o governo também intensifica a cobrança de impostos sobre os mais ricos e setores de alta lucratividade. “Bilionários, bancos e plataformas de apostas pagam nada ou quase nada de imposto de renda, vão passar a pagar mais. Porque imposto é necessário, mas justiça também é”, afirma o texto da campanha divulgado nas redes sociais.
Além do aumento do GGR, a MP ainda prevê restrições mais duras contra a propaganda de sites de apostas não licenciados e determina que redes sociais e provedores de internet tenham canais de comunicação direta com o governo para cumprimento de ordens urgentes. A medida busca combater o mercado ilegal, que, segundo estimativas da Associação Brasileira de Fantasy Sports (ABFS), movimenta até 50% do total de apostas no Brasil.
A falta de regulamentação efetiva nos últimos anos e a ausência de fiscalização intensiva resultaram em um ambiente favorável à proliferação de sites ilegais. Um estudo do Instituto Brasileiro de Jogo Responsável (IBJR) revelou que o país pode estar perdendo até R$ 10,8 bilhões por ano em arrecadação devido à atuação dessas casas de apostas não licenciadas.
