O Juizado Especial Cível da Comarca de Poções decidiu, na quarta-feira (16), determinar a retirada imediata de uma matéria publicada pelo blog Poções 24h, por conter informações falsas (fake news) direcionadas ao prefeito de Mirante, Edno – Edinho do Maracujá – Silva Nascimento (PT).
A decisão foi proferida em decorrência de uma Ação de Obrigação de Fazer com Pedido Liminar de Antecipação de Tutela, fundamentada no Artigo 5º, Inciso X, da Constituição Federal; no Artigo 21 da Lei Federal 12.905/14 (Marco Civil da Internet); e no Artigo 319 e seguintes do Código de Processo Civil, ajuizada pela defesa do prefeito Edno – Edinho do Maracujá – Silva Nascimento (PT), que alegou que o conteúdo publicado pelo blog no último dia 15 difamava o gestor ao insinuar, de forma infundada e sem provas, que ele estaria ligado a um empresário preso em uma operação da Polícia Federal. Além disso, a matéria sugeria, de maneira incorreta, que o prefeito teria recebido financiamento ilegal durante a campanha eleitoral de 2024 e que estaria sendo investigado no âmbito da Operação Overclean, deflagrada pela Polícia Federal em conjunto com a Controladoria Geral da União (CGU), com objetivo de desarticular uma organização criminosa envolvida em fraudes licitatórias, desvio de recursos públicos, corrupção e lavagem de dinheiro.
O juiz Ricardo Frederico Campos destacou a gravidade das acusações infundadas e ressaltou que a publicação possui “teor difamatório”, podendo causar danos irreparáveis à imagem do prefeito e prejudicar sua atuação como servidor público. “A permanência desse conteúdo na internet permite sua disseminação, atingindo um número indeterminado de pessoas e causando danos irreversíveis à reputação do autor (prefeito Edno – Edinho do Maracujá – Silva Nascimento) enquanto agente político”, afirmou o magistrado em sua decisão.
Na sentença, o magistrado estabeleceu que o conteúdo deveria ser removido do ar em até 24 horas, sob pena de multa diária de R$ 1 mil, limitada a R$ 50 mil em caso de descumprimento. O Processo agora aguarda uma audiência de conciliação e/ou mediação no Centro Judiciário de Solução Consensual de Conflitos – Cejusc – da Comarca de Poções.
A decisão do Juízo do Juizado Especial Cível da Comarca de Poções reforça a responsabilidade no exercício da liberdade de expressão, especialmente no ambiente digital, que não deve ser confundida com a disseminação de condutas ilícitas, como os crimes contra a honra, destacando que fake news não têm proteção legal sob o pretexto da liberdade de expressão.

Em resposta à reportagem do JS, o responsável pelo Blog Poções 24 Horas, demonstrando falta de ética, educação e profissionalismo, optou por atacar grosseiramente o “mensageiro” ao ser contactado para comentar ou refutar a denúncia feita pelo prefeito de Mirante e a decisão judicial que determinou a retirada da matéria considerada falsa que editou, deixando claro que desconhece a cartilha do bom jornalismo que tem como um de seus pilares inegociáveis o “Direito do Contraditório”, que orienta os jornalistas que ao reportar um fato se escute todas as partes envolvidas.
Na resposta, o blogueiro poçoense afirmou que “não deve satisfação ao JS” – o que é verdade e não foi solicitado, mas à população alcançada pela sua publicação – mas sim ao prefeito mencionado e à Justiça. O blogueiro, que afirma ter 20 anos de experiência no jornalismo, interpretou a iniciativa do JS de oferecer espaço para sua versão — um princípio fundamental do bom jornalismo, que garante o “Direito ao Contraditório” e permite que todas as partes mencionadas possam se manifestar, promovendo uma avaliação mais justa por parte do público — como uma tentativa de prejudicá-lo. Contudo, declarou que isso não afetará seus “20 anos de trabalho com responsabilidade”. E concluiu afirmando, textualmente, que a intenção do JS ao oferecer espaço para sua versão era “me prejudicar, mas não vai ser isso pra ranhar (sic) 20 anos de trabalho com responsabilidade”.
