STF determina mutirões carcerários para conceder benefício

O ministro Gilmar Mendes, do Supremo Tribunal Federal (STF), determinou nesta quinta-feira (9) a realização de mutirões carcerários para garantir o cumprimento de uma decisão da Segunda Turma que assegurou a substituição da prisão preventiva por prisão domiciliar para mães de crianças menores de 12 anos.
A decisão foi proferida em habeas corpus apresentado pela defesa da mãe de uma criança de 4 anos presa preventivamente por tráfico de 5 gramas de crack. Ao avaliar o caso, o ministro concedeu a prisão domiciliar à mulher por considerar que a quantidade de droga encontrada com ela era ínfima e não estaria ao alcance da criança.
“O juiz da instância de origem deverá fixar a forma de cumprimento e fiscalização e poderá determinar novas medidas cautelares se achar necessário”, informou o STF, em nota. Na decisão, Gilmar Mendes avaliou que a substituição da prisão preventiva pela domiciliar “vai muito além de uma benesse à mulher alvo da segregação cautelar”.
“A ideia é, por meio de tal flexibilização, salvaguardar os direitos das crianças que podem ser impactadas pela ausência da mãe. Por meio da medida, a ré permanece presa cautelarmente, mas passa a cumprir a segregação em seu domicílio, de modo a oferecer cuidados aos filhos menores”, apontou.
O ministro citou ainda a existência de sucessivas decisões em instâncias inferiores negando a concessão do benefício de prisão domiciliar para mães que preenchem os requisitos legais e, por isso, determinou a realização dos mutirões carcerários, a serem executados pelo Conselho Nacional de Justiça (CNJ).
“O objetivo da medida proposta é a revisão das prisões, a apuração das circunstâncias de encarceramento e a promoção de ações de cidadania e de iniciativas para ressocialização dessas mulheres”, afirmou.
