O Ministério Público do Estado da Bahia, através da 3ª Promotoria de Justiça da Infância e da Juventude de Guanambi, por meio do Promotor de Justiça Francisco de Freitas Júnior, orientou os Diretores Geral e Clínico do Hospital Regional e do Hospital Nova Aliança em Guanambi a cumprirem o que estabelece a legislação vigente e não solicitarem a apresentação de Registro de Ocorrência Policial (RO) ou Boletim de Ocorrência (BO) de crianças e adolescentes gestantes que foram vítimas de violência sexual como condição para a realização de procedimentos de interrupção de gravidez.
O documento enfatiza que essa exigência impõe barreiras indevidas ao acesso ao aborto legal, agravando o sofrimento das vítimas, especialmente entre crianças e adolescentes. O Promotor de Justiça Francisco de Freitas Júnior destacou a necessidade de revisar as normativas das Unidades de Saúde que impõem exigências inadequadas a mulheres, especialmente crianças e adolescentes, que são vítimas de abuso sexual e buscam por procedimentos abortivos em Guanambi.
Além disso, o Ministério Público do Estado da Bahia recomendou que, ao realizar o aborto, a identidade e os dados pessoais da gestante sejam preservados, assim como todos os documentos gerados e arquivados na Unidade de Saúde, a fim de evitar exposição e revitimização.
O Promotor de Justiça informou que a 3ª Promotoria de Justiça da Infância e Juventude tomou conhecimento de que, na rede pública de Saúde de Guanambi, no contexto do Sistema Único de Saúde, havia a exigência de uma ordem judicial para a realização da interrupção de gravidez resultante de estupro. Essa prática contraria a legislação vigente, que apenas requer a realização do procedimento por um médico e o consentimento da vítima gestante ou, no caso de incapacidade, de seu representante legal.
O Promotor de Justiça Francisco de Freitas Júnior ressaltou que a exigência de Boletim de Ocorrência ou decisão judicial para a interrupção da gravidez em vítimas de estupro viola o direito à saúde das mulheres e a integridade psicológica, além de infringir diversos compromissos internacionais dos quais o Brasil é signatário, como o Plano de Ação da Conferência do Cairo de População e Desenvolvimento (1994).
A Recomendação Ministerial foi emitida com base em diretrizes dos Centros de Apoio Operacional da Criança e do Adolescente (Caoca), Criminal (Caocrim), da Saúde (Cesau) e dos Direitos Humanos (CAODH) do Ministério Público do Estado da Bahia, em colaboração com o Ministério Público Federal, reafirmando a posição institucional em defesa dos direitos de crianças e adolescentes, bem como de outras vítimas de violência.
