Escritório da empresa no Brasil tem 30 dias para se manifestar

O Ministério Público Federal (MPF) oficiou nesta quarta-feira (8) a empresa Meta – que controla Facebook, Instagram e Whatsapp – sobre as mudanças que a companhia anunciou em relação às políticas de moderação de conteúdo de suas redes sociais. O MPF concede 30 dias úteis para o escritório da plataforma no Brasil se manifestar.
Entre os questionamentos do MPF, está se as mudanças anunciadas pelo dono da Meta, o empresário Mark Zuckerberg, serão aplicadas no Brasil. Além disso, questiona quando as mudanças entrariam em vigor no país e pede mais detalhes sobre as novas regras, “para avaliar em que medida elas podem, eventualmente, impactar direitos dos usuários destas plataformas que vivem em nosso país”.
Assinado pelo procurador da república Yuri Corrêa da Luz, do MPF de São Paulo (SP), o ofício foi enviado no âmbito do inquérito que apura, desde 2021, “eventuais violações de direitos fundamentais” por parte das principais plataformas digitais que operam no Brasil, desde o X, até o Telegram, TikTok e Youtube, além das redes controladas pela Meta.
O inquérito apura as medidas que as redes sociais adotam para detectar e combater ações como a produção de conteúdos falsos, o disparo de mensagens em massa e o uso de robôs e perfis fictícios.
Mudanças
A Meta anunciou uma série de mudanças na sua política de moderação de conteúdos, entre eles, o fim do programa de checagem de fatos que verifica a veracidade de informações que circulam nas redes; o fim de restrições para assuntos como migração e gênero; e a promoção de “conteúdo cívico”, entendido como informações com teor político-ideológico; e a exclusão apenas de conteúdos considerados violações graves.
O MPF pede que a Meta explique quais são as violações consideradas graves. “E quais violações, ao revés, passarão a ser consideradas ‘de baixa gravidade’, tornando-se objeto de moderação apenas e tão somente após provocação de terceiros, uma vez que o anúncio realizado na data de ontem não especificou detalhes desses enquadramentos”, afirma o documento.
O ofício ainda pede explicações de quais restrições em temas como imigração e gênero serão eliminadas. “Esclarecendo quais os impactos de tais mudanças para a política de moderação que, segundo informado nestes autos, seria aplicada hoje para conter discurso de ódio”, completou o documento.
Questionada pela Agência Brasil, a Meta informou que não comentará a notificação do MPF.
Discurso de ódio
As mudanças já aplicadas nos Estados Unidos permitem que os usuários associem a homossexualidade ou a transsexualidade à doenças mentais, apesar do consenso científico atual rejeitar esse tipo de tese.
Além disso, mudanças na política sobre discurso de ódio nas plataformas da Meta passaram a permitir, por enquanto apenas nos Estados Unidos (EUA), manifestações com insultos homofóbicos, xenófobos e até misóginos, no caso do contexto de fim de relacionamentos românticos.
“[As pessoas] pedem exclusão ou usam linguagem insultuosa no contexto de discussão de tópicos políticos ou religiosos, como ao discutir direitos transgêneros, imigração ou homossexualidade. Finalmente, às vezes as pessoas xingam um gênero no contexto de um rompimento romântico. Nossas políticas são projetadas para permitir espaço para esses tipos de discurso”, afirma a Meta.
Ao comentar as mudanças na plataforma, o diretor de assuntos globais da Meta, Joel Kaplan, sustentou que as regras estavam muito restritivas e que o objetivo é se livrar de restrições sobre imigração, identidade de gênero e gênero.
“Não é certo que as coisas possam ser ditas na TV ou no plenário do Congresso, mas não em nossas plataformas. Essas mudanças de política podem levar algumas semanas para serem totalmente implementadas”, justificou Kaplan.
