Acordo judicial fechado pelo Ministério Público do Trabalho (MPT) na Bahia com a Vedacit do Nordeste S.A. vai garantir recursos para dois hospitais filantrópicos especializados no atendimento de casos de câncer, além de assistência médica integral a ex-empregados da empresa afetados com contaminações químicas. O entendimento põe fim a uma longa disputa judicial iniciada em 2008 com o ajuizamento de uma ação civil pública que resultou ainda numa ação de execução na Justiça do Trabalho. Ao todo, serão destinados R$6,7 milhões para os hospitais Aristides Maltês e Martagão Gesteira, valores pagos a título de indenização por danos morais coletivos.
As unidades de saúde filantrópicas vão dividir o montante a ser pago em dez parcelas mensais a partir do dia 7 de outubro. Os recursos serão usados exclusivamente para aquisição de equipamentos. A destinação para unidades que prestam serviços públicos voltados para o tratamento do câncer se deu em função da natureza das irregularidades identificadas pelo MPT que deram origem à ação. No processo, ficou comprovada a relação de causalidade entre as práticas industriais na planta da Vedacit e doenças ocupacionais nos seus empregados. Por isso, além do dano moral, o acordo prevê que todos os ex-empregados que comprovem por laudo médico a existência de doença ocupacional decorrente do trabalho na empresa contarão com assistência médica integral por tempo indeterminado.
O procurador do MPT Luís Barbosa, que conduziu as negociações com a Vedacit, comemorou o resultado. “Fechamos o acordo incluindo várias obrigações de fazer, voltadas à proteção do meio ambiente do trabalho, prevenção de riscos ergonômicos e principalmente químicos, pela manipulação de produtos considerados carcinogênicos. Além disso, conseguimos garantir a assistência médica completa e gratuita aos ex-trabalhadores que comprovem provável origem ocupacional”. Ele ainda destacou a contribuição dos procuradores Pacífico Rocha e Luís Carneiro durante o processo.
O acordo negociado entre o MPT e a Vedacit foi homologado pela 34ª Vara do Trabalho de Salvador, onde tramitavam as duas ações judiciais. No documento, a empresa também se compromete a cumprir 16 obrigações relacionadas à adoção de medidas para a proteção da saúde e da segurança dos trabalhadores envolvidos no processo produtivo. As obrigações expressas já estão previstas nas normas regulamentadoras do Ministério do Trabalho e Previdência, mas no acordo existe a previsão da realização de inspeção pela auditoria-fiscal do trabalho em até cinco anos. Caso haja identificação de algum descumprimento, a Vedacit terá que ser notificada para corrigir a irregularidade em até 30 dias sob pena de multa de R$5 mil por cada obrigação descumprida.
