Na manhã da da última sexta-feira (1º), foi realizada uma operação conjunta de fiscalização pela Procuradoria-Geral do Município e pela Superintendência Municipal de Defesa do Consumidor de Vitória da Conquista (Procon/Vitória da Conquista), com apoio da Secretaria de Estado de Estado da Justiça, Direitos Humanos e Desenvolvimento Social da Bahia, por meio da Superintendência de Proteção e Defesa do Consumidor (Procon), e da Comissão de Direito Previdenciário da Subseção Vitória da Conquista da Ordem dos Advogados do Brasil (OAB/Vitória da Conquista), tendo como alvo a agência da Crefisa – Instituição Financeira especializada na concessão de crédito pessoal – localizada na Rua Maximiliano Fernandes, no centro da cidade. A operação teve como foco investigar possíveis práticas ilegais, especialmente contra aposentados e pensionistas, apontadas por denúncias recebidas recentemente.
De acordo com o Procurador Geral do Município, Jônatan Nunes Meireles, a ação foi desencadeada após uma denúncia formal feita pela Ordem dos Advogados do Brasil (OAB), tanto pela Seccional Bahia quanto pela Subseção local, junto à Superintendência de Proteção e Defesa do Consumidor (Procon), órgão da estrutura da Secretaria de Estado de Estado da Justiça, Direitos Humanos e Desenvolvimento Social da Bahia, apontando possíveis práticas abusivas no atendimento ao público e na concessão de crédito, especialmente a consumidores hipervulneráveis (idosos, pessoas com deficiência e de baixa escolaridade) em agências da Instituição Financeira em diversos municípios do Estado, inclusive a de Vitória da Conquista.
“Relatos, denúncias e dossiês reunidos indicam condutas potencialmente vedadas pela legislação, especialmente relativas à administração de benefícios”, explicou Procurador Geral do Município, Jônatan Nunes Meireles. Segundo ele, entre as irregularidades investigadas em Vitória da Conquista, especificamente, estão a formação de longas filas e tempo excessivo de espera, ausência de acessibilidade adequada nas agências, insuficiência de assentos e banheiros adequados, informações confusas ou incompletas prestadas aos consumidores, possíveis falhas na formalização de contratos e atuação de correspondentes bancários, cobranças indevidas e juros abusivos.
A vice-presidente da Subseção da Ordem dos Advogados do Brasil de Vitória da Conquista (OAB/Vitória da Conquista, Juliana Vaz Barbosa de Araújo, que acompanhou de perto a toda a operação, destacou a relevância dessa atuação conjunta para coibir práticas abusivas e promover maior segurança jurídica para a população. Segundo ela, a Subseção da Ordem dos Advogados do Brasil possui a prerrogativa de identificar irregularidades e buscar o apoio do município para garantir a efetividade de seu poder fiscalizatório. Além disso, ressaltou, cabe à Entidade realizar visitas técnicas, elaborar relatórios e validar os apontamentos feitos pela Comissão de Direito Previdenciário. “A fiscalização de hoje (sexta-feira, 1º de agosto) tem como objetivo analisar aspectos estruturais e procedimentais de uma agência bancária, para que, posteriormente, sejam adotadas as medidas cabíveis e todos os direitos dos hipervulneráveis sejam assegurados”, sublinhou a Advogada Juliana Vaz.
A operação não se restringe a Vitória da Conquista, mas faz parte de uma ação mais ampla que está acontecendo em outras cidades do Estado, conforme destacou Jônatan Nunes Meireles.
