Os recursos do Programa Nacional de Apoio às Microempresas e Empresas de Pequeno Porte (Pronampe) podem se tornar permanentes. É o que prevê o projeto de lei (PL 6.012/2023), de autoria dos senadores Esperidião Amin (PP/SC), Jorge Seif (PL/SC) e Ivete da Silveira (MDB/SC).
A análise da proposta deveria ter ocorrido no dia 25 de junho na Comissão de Assuntos Econômicos (CAE), mas foi adiada a pedido do relator, senador Laércio Oliveira (PP-SE), para que o tema seja mais discutido e votado no segundo semestre – na volta do recesso parlamentar, em agosto.
O relator destacou, em reunião na comissão, que o governo ainda avalia a destinação dos recursos previstos no projeto, pois uma das partes em análise é o uso do dinheiro para outra iniciativa – o Programa Pé-de-Meia (Lei 14.818, de 2024). Essa lei garante um incentivo financeiro a estudantes da rede pública para estimular a permanência escolar e a conclusão do ensino médio.
“É um projeto extremamente importante para o país, para as micros e pequenas empresas, uma vez que a lei que rege o Pronampe encerra-se no final do próximo ano e a gente quer torná-la permanente. Mas existe uma ação do governo para que parte desses recursos seja destinada ao Programa Pé-de-Meia, que é um programa também que a gente entende extremamente importante para o país”, afirmou o senador Laércio Oliveira.
Permanência dos recursos
O advogado empresarial, sócio da Mendes Advocacia & Consultoria e mestre em gestão de negócios, Lucca Mendes, de Belém (PA), avalia que a proposta impacta positivamente os pequenos empresários.
“As mudanças propostas podem ter impactos significativos no setor das pequenas empresas, incluindo melhorias no acesso ao crédito e condições mais favoráveis de financiamento. Estabilizar o Pronampe com recursos contínuos permitirá que mais empresas tenham acesso a empréstimos necessários para sua operação e expansão, o que é vital, especialmente em períodos de crise ou baixo crescimento econômico”, diz.
Lucca Mendes destaca, ainda, benefícios da permanência dos recursos do Pronampe, como geração de empregos a partir das oportunidades de créditos, estímulo ao empreendedorismo e à inovação. “Fatores essenciais para a recuperação e dinamismo econômico”, pontua Mendes.
O empresário de Marketing Digital, Eder Jason, 35 anos, de Brasília (DF), tentou conseguir investimentos pelo Pronampe, mas foi negado. Apesar disso, ele conta que pretende fazer um novo pedido no segundo semestre deste ano. Para ele, o Pronampe fortalece o setor a partir da fonte de financiamento estável. “Que é crucial para o planejamento de crescimento a longo prazo de nós, pequenos empreendedores”, salienta.
Para Eder Jason, a aprovação da proposta é necessária também para contribuir para a economia do país. “A proposta do Senado é essencial e deveria ser aprovada a permanência do recurso do Pronampe. Porque isso proporcionaria uma base sólida para que nós, como pequenos empreendedores, pequenas empresas, possamos investir em inovação, expandir de operação e garantir empregos também, contribuindo significantemente para a economia do país.
Como é e como deve ficar
O Pronampe foi criado pela Lei nº 13.999, em 2020, para apoiar financeiramente os micro e pequenos negócios na pandemia de Covid19. Era temporário, mas se tornou permanente em 2021 (Lei nº 14.161). Apesar das Leis garantirem a continuidade do Programa, ficou mantida a descontinuidade do Fundo Garantidor de Operações (FGO) a partir de janeiro de 2025, com o retorno dos valores para o Tesouro Nacional.
No texto alternativo, Laércio Oliveira substituiu um trecho da Lei de 2020 para estabelecer que, dos valores recuperados ou não utilizados como garantia, no mínimo 70% deverão ser direcionados novamente, a partir de janeiro de 2025, para garantir empréstimos feitos por meio do Pronampe.
Nesse caso, o restante não utilizado poderá ser empregado para integrar a poupança do Pé-de-meia, destinado a estudantes matriculados no Ensino Médio público, como forma de incentivá-los a permanecer na Escola e concluir os estudos.
Em relação à Lei 14.161, o relator manteve a previsão de descontinuidade do Fundo. Ele justifica que considera que essa Lei trata de valores não utilizados ou recuperados provenientes apenas de créditos extraordinários.
A decisão da CAE será terminativa, ou seja, se aprovado lá, o texto segue para a Câmara dos Deputados, a menos que haja pedido de senadores para votação em plenário.
