Consumidor deve ficar atento a prazos

Passado o período de Natal, começa a troca de presentes típica da época. E muitos consumidores vão às lojas para fazer a troca, seja por não servir ou mesmo por não ter agradado. O Procon-SP alerta, no entanto, que as lojas não são obrigadas a fazer essa troca, a obrigação é apenas quando avisam claramente dessa possibilidade no momento da compra ou se o produto tiver algum defeito. Nas compras pela internet, os critérios são os mesmos, mas há o direito ao arrependimento, segundo o Código de Defesa do Consumidor.
O Procon-SP recomenda que para fazer a troca, o consumidor deve manter a integridade do produto e atender às condições estabelecidas, como manter a etiqueta e guardar a nota fiscal ou recibo de compra para apresentar na hora de fazer a troca. O ideal, segundo o Procon-SP, antes de comprar um presente, é que se tenha o máximo de informações, .
“Na compra de itens em promoção, o consumidor também tem seus direitos garantidos. Porém, é recomendável ter cuidado com itens vendidos nessas condições, pois podem estar danificados ou apresentar pequenos defeitos, especialmente nas mercadorias de mostruário. Nesses casos, deve-se solicitar que o estado geral do produto seja especificado no pedido ou na nota fiscal, assim como as possíveis condições para troca”, alerta o Procon-SP.
Segundo as orientações do Procon-SP, quando a troca for por gosto ou tamanho, vale o acordado com a loja e as informações devem ser exibidas de forma clara ao consumidor. Se a troca for por defeito, o prazo para o consumidor reclamar pelos defeitos aparentes ou de fácil constatação é de 30 dias, nos casos de produtos não duráveis. Para os produtos duráveis esse prazo aumenta para 90 dias. No caso de um problema oculto, o prazo inicia-se quando ficar evidenciado o defeito.
O valor pago pelo item prevalece no momento da troca, mesmo quando houver liquidações ou aumento de preço. Quando a troca é pelo mesmo produto de marca e modelo, mudando apenas o tamanho ou a cor, o fornecedor não pode exigir complemento de valor; nem o consumidor poderá solicitar abatimento do preço, caso haja mudança entre o valor pago no dia da compra e o preço no dia da troca.
Quando a compra for feita pela internet, o consumidor conta com o direito de arrependimento, podendo devolver o produto em até 7 dias da data de aquisição ou recebimento da mercadoria. Entretanto, o Procon-SP indica o consumidor a formalizar a desistência por escrito. A devolução pode ser feita com o direito de receber o valor pago de volta.
A orientação do Procon-SP é a de que, caso haja algum problema para trocar o item, o consumidor procure o Procon de sua cidade para formalizar a reclamação. Em São Paulo isso pode ser feito pelo site do serviço de defesa do consumidor.
