É um absurdo e uma afronta às conquistas democráticas, configuradas na Lei da Ficha Limpa, de iniciativa popular, a decisão de 50 senadores de promoverem alteração no dispositivo legal para favorecer políticos corruptos condenados a poderem concorrer nas próximas eleições.
A norma foi criada pela iniciativa popular para justamente combater a corrupção política e não pode regredir ao estágio inicial para atender aos interesses de políticos corruptos. Ou seja, antes, o prazo de inelegibilidade de 8 anos começava a contar após o cumprimento da pena ou o fim do mandato. Agora, esse prazo passa a ser a partir da condenação por órgão colegiado, da cassação ou da renúncia ao cargo.
Um exemplo prático é o do ex-senador Ivo Cassel, condenado pelo STF por fraude em licitação. Com a regra anterior, ele permaneceria inelegível por até 11 anos, somando o tempo restante do mandato mais 8 anos da Lei da Ficha Limpa. Com a nova regra, o prazo é fixado em 8 anos, contados a partir da condenação, o que pode viabilizar sua candidatura ao governo de Rondônia em 2026.
O Senado não pode invalidar, em parte ou no todo, uma decisão popular. Isso é uma provocação antidemocrática, inconstitucional e um desrespeito à manifestação da sociedade, consagrada na Lei da Ficha Limpa.
Afinal, o povo é o principal agente da democracia. É ele que elege o Legislativo e o Executivo. Portanto, o povo merece ser respeitado.
Para votar projetos de interesse social, não se vê empenho desses fajutos parlamentares corporativistas. Mas para favorecer políticos corruptos condenados, senadores indecorosos se corrompem moralmente para desrespeitar as regras democráticas.
Gostaríamos de ver o senador Davi Alcolumbre (União-AP) ser incisivo para defender os anseios sociais e não os interesses políticos: “Eu faço questão dessa modernização, dessa atualização da legislação da Lei da Ficha Limpa para dar o espírito do legislador quando da votação da lei. A inelegibilidade, ela não pode ser eterna. Está no texto da lei oito anos, não pode ser nove nem vinte. O meu voto é sim”.
O senador Davi Alcolumbre está na contramão do que pensa a população brasileira, que exige respeito e moralização política e, por isso, ela criou a Lei da Ficha Limpa bem elaborada.
A atitude do Senado, aprovada por Alcolumbre, tem contribuído para o descrédito do Parlamento, bem como para o desinteresse político da sociedade pela política encardida, por exemplo, praticada por 50 senadores.
A cassação por corrupção deveria ser definitiva e exemplar. A política exige seriedade e respeito à liturgia dos cargos e das instituições que os sustentam. Ficha suja não pode ter vez no Legislativo.
Lembramos aos que se consideram úteis e insubstituíveis que no cemitério jazem vários deles, sem que o país tenha sentido as suas ausências.
A sociedade espera que o presidente da República, com dignidade, vete o projeto de lei que trata da alteração na Lei da Ficha Limpa, por ser inconstitucional ao interferir em cláusula pétrea conquistada pela população.
