O Senado aprovou nesta quarta-feira (18) o Projeto de Lei 2.687/2022, que equipara o diabetes mellitus tipo 1 a uma deficiência para todos os efeitos legais. O texto já havia tramitado na Câmara dos Deputados e agora seguirá para sanção presidencial.
“Nossa expectativa é que essas pessoas tenham a atenção que o Estado lhes deve há muito tempo”, afirmou o relator da matéria, senador Alessandro Vieira (MDB-SE). Em todo o país, segundo dados oficiais, cerca 600 mil pessoas possuem diabetes tipo 1.
Trata-se de uma doença crônica não transmissível que ocorre quando o sistema imunológico ataca as células do pâncreas que produzem insulina. Isso resulta em uma deficiência de insulina, que impede a glicose de entrar nas células e faz com que os níveis de glicemia no sangue aumentem.
Os defensores do projeto ressaltam que Estados Unidos, Reino Unido, Espanha e Alemanha já classificam o diabetes tipo 1 como deficiência. A Federação Internacional de Diabetes estima que o Brasil ocupe o 6º lugar no mundo entre os países com mais pessoas com diabetes no geral e o 3º lugar quando se trata de diabetes tipo 1.
Na prática, o texto agora aprovado pelo Congresso Nacional prevê que valerá para o diabetes tipo 1 as mesmas regras já previstas para pessoas com deficiência, conforme estabelecido pelo Estatuto da Pessoa com Deficiência.
De acordo com essa lei, a avaliação para constatar a deficiência é biopsicossocial e deve ser realizada por equipe multiprofissional e interdisciplinar. Considera-se pessoa com deficiência aquela que tem impedimento de longo prazo de natureza física, mental, intelectual ou sensorial que dificulta sua participação na sociedade em igualdade de condições com as demais pessoas.
