Atividade exige cumprimento de normas de segurança financeira

A Secretaria de Prêmios e Apostas (SPA) do Ministério da Fazenda divulgou lista de 66 empresas que estão liberadas a partir desta quarta-feira (1º de janeiro) a explorar o mercado nacional de apostas eletrônicas de quota fixa, as chamadas de bets.
A autorização para as empresas operarem bets no Brasil depende do pagamento de outorga de R$ 30 milhões. Cada portaria de liberação permite o uso de até três marcas por empresa. No total, mais de R$ 2 bilhões foram pagos pelas empresas para obterem as outorgas. O número de empresas autorizadas corresponde a 58% dos pedidos iniciais (113).
De acordo com a lista de empresas da SPA, o mercado regulado de bets terá inicialmente 139 marcas. Todas deverão operar exclusivamente no domínio “.bet.br”. As empresas detentoras das marcas terão de cumprir normas de segurança financeira e práticas de jogo responsável, e respeito à legislação contra a lavagem de dinheiro.
As portarias que concedem autorização foram publicadas na edição de 31 de dezembro do Diário Oficial da União. Catorze empresas receberam de liberações definitivas e 52 empresas tiveram autorizações provisórias pois ainda estão pendentes na apresentação de informações ou documentos como a certificação do sistema de apostas.
Restrições legais
Segundo a SPA, empresas em atividade que não tiverem autorização oficial não poderão fazer transações financeiras e serão bloqueadas na internet. “As instituições financeiras e de pagamento passam a ser vedadas de realizar transações, que tenham por finalidade a realização de apostas de quota fixa com pessoas jurídicas que não tenham recebido a autorização. Aquelas empresas não autorizadas, mas que continuam com domínios ativos que ofertam serviço de aposta de quota fixa são consideradas ilegais e serão bloqueadas”, detalha nota da secretaria.
Divulgação da SPA também afirma que a regulamentação “possibilitará corrigir problemas estruturais do setor e mitigar riscos associados à prática de apostas, como o jogo problemático e o superendividamento.” Conforme a nota, para evitar esses problemas haverá “controle rigoroso dos fluxos financeiros.”
Além disso, estão proibidos a concessão de crédito pelas bets aos usuários para apostas e de bônus de entrada, e deverá haver identificação dos apostadores por CPF, com reconhecimento facial.
Em entrevista concedida à Agência Brasil após as empresas entrarem com pedidos para terem autorização para explorarem as bets, o secretário de Prêmios e Apostas do Ministério da Fazenda, Regis Anderson Dudena, o enquadramento das bets só foi possível porque, depois de cinco anos de vácuo, durante os governos de Michel Temer e Jair Bolsonaro, o Brasil passou a ter uma lei que regulamenta o setor (Lei nº 14.790), sancionada em dezembro de 2023.
