Xenofobia no Parlamento veste terno e gravata

Recentemente, o vereador Mateus Batista, da cidade de Joinville (SC), proferiu declarações que ultrapassam todos os limites do aceitável em uma democracia. 

O vereador criticou a migração de pessoas do Norte e Nordeste para Joinville, chamando o Pará de “lixo” e defendeu um controle rígido sobre a entrada de novos moradores para a cidade não se transformar num “favelão”.

Esse tipo de discurso não é apenas moralmente repulsivo. É ilegal. A Constituição de 1988, em seu artigo 5º, garante a todos os brasileiros o direito de ir e vir livremente pelo território nacional. O artigo 3º estabelece como objetivo fundamental da República promover o bem de todos, “sem preconceitos de origem, raça, sexo, cor, idade e quaisquer outras formas de discriminação”. E o artigo 19 proíbe qualquer ente federativo de criar distinções entre brasileiros.

A fala do vereador configura xenofobia — preconceito contra pessoas de outras regiões do país — e pode ser enquadrada na Lei nº 7.716/1989, que trata dos crimes de racismo e preconceito de procedência nacional. Com as atualizações recentes, a injúria racial coletiva passou a ser considerada crime de racismo, imprescritível e inafiançável. 

Mais grave ainda é que essas declarações foram feitas por um agente público, eleito para representar todos os cidadãos de sua cidade. Quando um parlamentar utiliza seu cargo para disseminar preconceito, ele quebra o decoro exigido pela função. E isso, segundo o Decreto-Lei n.º 201/1967, é motivo legítimo para cassação de mandato. 

Há precedentes. Vereadores em outras cidades brasileiras já foram cassados por declarações racistas e xenofóbicas. A democracia exige limites claros: liberdade de expressão não é liberdade para discriminar. 

O Brasil é uma nação plural, formada por povos de todas as regiões, culturas e histórias. O Norte e o Nordeste são berços de resistência, arte, saberes ancestrais e contribuições fundamentais para a identidade nacional. Reduzir essas regiões a estereótipos ofensivos é não apenas ignorância — é um ataque direto à dignidade de milhões de brasileiros. 

Diante disso, é urgente que o Ministério Público, a Câmara Municipal de Joinville e os órgãos de controle legislativo tomem providências. A impunidade institucionaliza o preconceito. E a democracia não pode tolerar isso. Santa Catarina é terra de diversidade. O Brasil é um país de todos. E o Parlamento — seja municipal, estadual ou federal — deve ser espaço de respeito, não de segregação.
