Segundo a Confederação Nacional dos Trabalhadores em Educação, o percentual do piso para 2023 está previsto em 14,9%
O ano de 2023 promete ser um ano importante para os professores públicos, dos estados e dos municípios. Isso devido ao reajuste do piso nacional do magistério para 2023 que é estimado em 14,9% e deve elevar a base dos salários dos professores para R$ 4.420,36 segundo a Confederação Nacional dos Trabalhadores em Educação (CNTE). A medida leva em conta a Lei 11738, de 2008, que determina que o piso nacional do magistério público da educação básica vai ser atualizado anualmente.
De acordo com o especialista em direito público, Karlos Gomes, essa atualização é calculada utilizando-se do mesmo percentual de crescimento do valor anual mínimo por aluno. “Esse aumento é dado para todos da carreira de magistério, ou seja, tanto para os professores em atividade, quantos para os aposentados. O PIS é nacional, portanto, ele deve ser aplicado em todas as esferas, seja estadual, municipal, distrital e tem por objetivo garantir um salário-mínimo para os profissionais da educação”, explica o advogado.
Segundo dados divulgados pela portaria do MEC, em 2022, a categoria teve o maior aumento de todos os tempos. Contudo, “existem diversos municípios e estados onde o poder público local não respeita o aumento dos valores, com a justificativa de que não possuem disponibilidade orçamentária para aplicar o aumento”, destaca Karlos Gomes.
A Lei 11.738 garante que o Governo Federal pode socorrer aqueles estados e municípios que não possuam recursos. “Após o requerimento devidamente comprovado, a ausência de dotação orçamentária, a união irá complementar tais valores e, assim, caso a prefeitura, o estado não respeitem a aplicação desse aumento, o professor pode ingressar com uma ação judicial requerendo a aplicação do aumento de sua folha de pagamento”, explica o advogado.
Para o professor de artes, Adeilton Oliveira, desde a criação do piso nacional, começou a se ter um impacto bom entre a categoria, uma vez que está nivelando o salário dos professores. “Se for colocado em prática pelos municípios e pelos estados, ele está equiparando os salários dos professores, praticamente no Brasil inteiro. Não está tendo aquela discrepância que tinha antes, de professor receber menos que o salário-mínimo e o governo ter que complementar. Eu acho justíssimo e ainda acredito que os professores da base, de primeira à quarta série, deveriam receber até um incentivo maior pela questão da alfabetização dos alunos. Então, essa questão da valorização do professor está sendo muito bem vista por nós e eu acredito que essa valorização tem que continuar”, destaca o professor.
