Especialistas alertam para fiscalização no uso desta nova tecnologia

Criado para garantir direitos e a proteção de pessoas com menos de 18 anos, o Estatuto da Criança e do Adolescente (ECA) completa 34 anos hoje (13). O marco legislativo, de 13 de julho de 1990, permitiu avanços importantes nas áreas de Educação e de Saúde Infantil, além da criação de órgãos como os Conselhos Tutelares e as Varas da Infância e Juventude.
Hoje, surgem novos desafios que na década de 1990 eram inexpressivos ou inexistentes. A proteção das crianças e adolescentes no ambiente digital é um deles. Especialistas e autoridades no tema alertam para a necessidade de ampliar as formas de Eucação, conscientização e fiscalização no uso das novas tecnologias.
“Sem o letramento digital, sem o supervisionamento, à mercê de dinâmicas mercadológicas e em substituição a condições saudáveis de desenvolvimento, o uso inadequado da internet pode se tornar um meio de adoecimento físico e mental significativo. É por reconhecer esse cenário múltiplo que falar de infâncias e juventudes hoje passa necessariamente por um debate sobre o uso consciente de telas e dispositivos, e a violência no ambiente digital, que reorganiza responsabilidades entre governo, sociedade, empresas e famílias”, disse a presidenta do Conselho dos Direitos da Criança e do Adolescente (Conanda), Marina de Pol Poniwas, em seminário realizado pelo Ministério dos Direitos Humanos e da Cidadania (MDHC) em Brasília, na última quinta-feira.
Renata Escudero, advogada, Mestre em Direitos Humanos e coordenadora do escritório da Human Rights Watch no Brasil, destaca os perigos sobre o uso inadequado de dados digitais de crianças e adolescentes. Um deles é o de alimentar ferramentas de inteligência artificial (IA) que podem, entre outros problemas, gerar imagens e vídeos sexuais falsos.
“A gente deveria olhar melhor para a proteção de dados. Essas tecnologias [como as de IA] avançam em uma velocidade que a legislação muitas vezes não consegue alcançar. É o que a gente está vivendo agora. Elas têm por base a violação dos dados, ao não respeitar a privacidade de crianças e adolescentes. Deveríamos proibir a produção de réplicas digitais não consensuais ou manipulação de imagens de crianças. Quanto mais explícitos e protetivos formos em relação aos dados dos adolescentes na legislação, mais seguras nossas crianças vão estar online”, disse Renata Escudero durante o evento.
advogado Marcos Ehrhardt Júnior, vice-presidente da Comissão Nacional de Família e Tecnologia do Instituto Brasileiro de Direito de Família (IBDFAM), concorda que existe um descompasso entre as regulações e o uso das plataformas digitais.
A velocidade dos avanços tecnológicos e a disseminação do ambiente digital é um desafio em todo o mundo, em especial para o Poder Legislativo. No momento, o Poder Judiciário vem-se valendo de princípios gerais e da interpretação dos operadores jurídicos para enfrentar a crescente demanda de intervenção para proteção de direitos fundamentais no ambiente digital”, disse o advogado ao site do IBDFAM. “Entender o funcionamento das plataformas, tomar ciência dos principais aspectos dos seus termos de uso e buscar informação sobre o marco regulatório de proteção de dados pessoais, inaugurado com o advento da Lei Geral de Proteção de Dados, seria um ótimo começo”.
Resolução do Conanda
No início de abril desse ano, o Conanda publicou um conjunto de normas sobre direitos das crianças e adolescentes em ambiente digital, a Resolução 245/2024. Ela trata do combate à exclusão digital, mas também traz determinações sobre proteção.
O texto dela afirmam que todos os menores de 18 anos devem ter direito de acesso a “tecnologias da informação e comunicação, como redes, conteúdos, serviços e aplicativos digitais disponíveis no ambiente virtual; dispositivos e ambientes conectados; realidade virtual e aumentada; inteligência artificial (IA); robótica; sistemas automatizados, biometria, sistemas algorítmicos e análise de dados.”
A resolução também diz que o Poder Público e a sociedade têm o dever zelar pela liberdade de expressão e pelos direitos de buscar, receber e difundir informação “segura, confiável e íntegra”. É garantida “a proteção contra toda forma de negligência, discriminação, violência, crueldade, opressão e exploração, inclusive contra a exploração comercial.”
O texto considera que “violações de direitos relacionadas aos riscos de conteúdo, contrato, contato e conduta incluem, dentre outros, conteúdos violentos e sexuais, cyber agressão ou cyberbullying, discurso de ódio, assédio, adicção, jogos de azar, exploração e abuso – inclusive sexual e comercial, incitação ao suicídio, à automutilação, publicidade ilegal ou a atividades que estimulem e/ou exponham a risco sua vida ou integridade física.”
Empresas que atuam no ambiente digital são compelidas a encaminhar denúncias de violação dos direitos à Ouvidoria Nacional dos Direitos Humanos, por meio do Disque 100, e também às autoridades do Sistema de Garantia de Direitos, como conselhos tutelares e autoridades policiais. O não encaminhamento está sujeito às penalidades previstas no ECA.
Notícias falsas
Os ambientes digitais também têm sido propícios para a veiculação de notícias falsas em relação ao ECA. Em entrevista ao programa Viva Maria, apresentado pela jornalista Mara Régia, da EBC a secretária executiva da Coalizão pela Socioeducação, Thaisi Bauer, falou sobre um dos principais tópicos explorados por grupos de desinformação da extrema-direita: jovens infratores e a redução da maioridade penal.
“Existem proposições aí discutindo a possibilidade de realização de plebiscito para reduzir a maioridade penal. Saiu na mídia, na semana passada, que uma parlamentar vai pautar isso antes das eleições. São pautas panfletárias. A gente chamou uma reunião grande com movimentos sociais e entidades, que tratam da defesa da criança e do adolescente, para tentar impedir que retrocessos das garantias presentes no ECA avancem”, diz Thaisi Bauer.
Diversidade de infâncias
O Conselho Nacional de Justiça (CNJ) anunciou o lançamento de um novo projeto em comemoração aos 34 aos do ECA. O “Diversidades das Primeiras Infâncias”, que destaca as diferenças entre as infâncias das crianças indígenas, negras, deficientes, de terreiro e em situação de rua. O objetivo é justamente reforçar a garantia de direitos fundamentais de todas as crianças, independentemente de classe social, raça, etnia, religião ou gênero.
O juiz auxiliar da Presidência do CNJ, Edinaldo César Santos Junior, disse que é fundamental que os Poderes Executivo, Legislativo e Judiciário, juntamente com a sociedade civil, elaborem políticas públicas específicas que considerem a diversidade das infâncias. Ele citou, nesse sentido, o Marco Legal da Primeira Infância (Lei nº 13.257/2016).
“A Lei reconhece a necessidade de considerar as diferenças entre as crianças em seus contextos sociais e culturais, combatendo as desigualdades no acesso aos bens e serviços essenciais para o seu desenvolvimento integral”, disse Edinaldo ao site da CNJ.
No segundo semestre de 2024, a CNJ promoverá as “Semanas das Diversidades nas Primeiras Infâncias” nas cinco regiões do Brasil, com foco específico para uma determinada infância.
“Para cada semana, serão identificados os estados brasileiros que possuem o maior número de crianças, com até seis anos, da diversidade a ser trabalhada, bem como os principais atores, locais e nacionais, que desenvolvem atividades focadas nessa população”, disse a juíza auxiliar da Presidência do CNJ, Rebeca Mendonça Lima.
