Decisão considera necessidade prestação de contas e transparência

O ministro Flávio Dino, do Supremo Tribunal Federal (STF), determinou, neste domingo (12), que os governos federal e estaduais apresentem, em um prazo de 30 dias, a publicação de normas para uso de recursos de emendas parlamentares federais em instituições de ensino superior.
A decisão do ministro leva em conta a necessidade de “prestação de contas adequadas quanto às emendas parlamentares federais, com transparência e rastreabilidade” tanto nas universidades “como nas suas respectivas Fundações de Apoio”.
Dino fez a determinação ao ministério da Educação (MEC), à Controladoria-Geral da União (CGU) e à Advocacia-Geral da União (AGU) e, “por simetria”, aos Estados, que deverão “proceder da mesma maneira”.
Dino pediu urgência na divulgação e determinou que a decisão tenha ciência dos presidentes da Associação Nacional dos Dirigentes das Instituições Federais de Ensino Superior (Andifes) e do Conselho de Reitores das Universidades Brasileiras (CRUB).
“Maior volume”
No despacho, o ministro contextualizou que a CGU apresentou os resultados de auditoria realizada sobre as 33 entidades sem fins lucrativos que receberam o maior volume de empenhos e o maior valor de pagamentos oriundos de emendas parlamentares no período de 2 de fevereiro a 21 de dezembro no ano passado.
“Entre as entidades selecionadas na amostra, há um número significativo de Fundações de Apoio a Universidades (…) há relatos nos autos de que tais Fundações, por intermédio de contratações de ONGs sem critérios objetivos, têm servido como instrumentos para repasses de valores provenientes de emendas parlamentares”, argumentou o ministro.

Flávio Dino é relator da ação (movida pelo Psol) contra a falta de transparência da destinação de recursos públicos do Orçamento federal, liberados pelo Congresso Nacional.
No último dia 3, Dino mandou suspender nesta-sexta-feira (3) o pagamentos de emendas parlamentares a Organizações Não Governamentais (ONGs) não transparentes.
Em dezembro, o ministro suspendeu o pagamento de R$ 4,2 bilhões em emendas por entender que os recursos não cumpriram os critérios de transparência e rastreabilidade.
Ele ainda determinou a instauração de um inquérito policial para apurar o caso. No último dia do ano (31), liberou R$ 370 milhões em emendas de comissão do Congresso para a saúde.
