Ministro determinou que PF investigue suspeitas de irregularidades

O ministro Flávio Dino, do Supremo Tribunal Federal (STF), determinou nesta segunda-feira (15) que o governo suspenda os repasses de emendas parlamentares para nove dos dez municípios que mais receberam as chamadas “emendas Pix” entre os anos de 2020 e 2024, incluindo capitais como o Rio de Janeiro. 
As “emendas Pix” ganharam essa alcunha por permitirem o repasse de recursos federais a estados e municípios por meio de transferência direta aos cofres do ente federado, sem que fosse identificado o político responsável pela indicação, como o dinheiro foi utilizado ou o beneficiário final do dinheiro público.
A suspensão determinada por Dino atinge emendas com suspeitas de irregularidades diversas identificadas pela Controladoria-Geral de União (CGU) que, por ordem do Supremo, auditou a execução das emendas Pix. Dino determinou que a Polícia Federal (PF) investigue tais suspeitas.
Em outra decisão, também desta segunda (15), Dino determinou que informações do Tribunal de Contas da União (TCU) sobre repasses de R$ 85 milhões, relativos a 148 emendas individuais sem plano de trabalho cadastrado, sejam encaminhadas para que a PF apure possíveis desvios na aplicação dos recursos públicos.
“A instauração dos inquéritos deverá ser realizada por estado, a fim de apurar a eventual prática dos seguintes ilícitos penais: prevaricação, desobediência a ordem judicial, emprego irregular de verbas públicas, peculato, corrupção, entre outros que se revelem no curso das investigações”, detalhou Dino.
Em 2024, esse tipo de repasse foi restringido pelo Supremo, que passou a exigir critérios mínimos de transparência e rastreabilidade para a liberação de recursos. Segundo a CGU, entre 2020 e 2024 foram destinados mais de R$ 17,5 bilhões em emendas Pix para estados e municípios.
Auditoria
Numa auditoria sobre a execução de tais emendas nos dez municípios que mais receberam esse tipo de recurso, a CGU só não encontrou irregularidades em relação à cidade de São Paulo. As outras nove cidades, e os respectivos tipos de irregularidades encontradas, são:
- Carapicuíba (SP) – Falhas na formalização do processo licitatório relativo ao Contrato nº 145/2022;
- São Luiz do Anauá (RR) – Obras paralisadas, com prazo de vigência exaurido;
- São João de Meriti (RJ) – Indicativos de superfaturamento;
- Iracema (RR) – Objetos executados fora das especificações técnicas;
- Rio de Janeiro (RJ) – Indícios de superfaturamento;
- Sena Madureira (AC) – Ausência de documentos comprobatórios de entrega de produto;
- Camaçari (BA) – Desvio do objeto da execução do Contrato no. 320/2022;
- Coração de Maria (BA) – Contratação de empresa sem comprovação de capacidade técnica;
- Macapá (AP) – Indicativos de superfaturamento.
Em relação à transparência, a CGU observou ausência ou insuficiência de informações sobre as emendas nos Portais da Transparências desses mesmos municípios. Ainda, nessas mesmas cidades há irregularidades relativas à rastreabilidade dos recursos, como a não abertura de conta específica para o recebimento do dinheiro, uma determinação do Supremo.
