Tenho um texto preparado para encaminhar à imprensa sobre como o Brasil parece ter enlouquecido de vez. Ontem, a Câmara dos Deputados colocou a cereja nesse bolo de desatino ao aprovar, com votação expressiva, a chamada PEC da blindagem.
Venho reiterando em meus comentários a passividade do povo brasileiro, quebrada recentemente pelas manifestações nas redes sociais. Mas essa mesma indignação precisa sair da virtualidade e ocupar as ruas, para não permitir de jeito nenhum que mais esse acinte do Congresso Nacional seja aprovado sem reação firme da sociedade.
Até 2001, um parlamentar só poderia ser processado no exercício do mandato com autorização da Câmara ou do Senado. Eu já defendia o fim dessa excrescência, pois considerava inconstitucional: o bem maior protegido pelo Direito é a vida, e a regra abria caminho para a impunidade absoluta.
Explico: como no Brasil só há pena de morte em caso de guerra declarada (CF, art. 5º, XLVII, “a”), aquela regra criava, de forma indireta, outra hipótese de pena de morte. Bastaria ao parlamentar ter o apoio de seus pares para bloquear qualquer processo, garantindo proteção para mandar matar desafetos sem risco de punição. Essa lógica se aplicava também a outros cargos protegidos pela norma.
Em 2001, o bom senso prevaleceu e essa brecha foi extinta. Agora, em 2025, passados 24 anos, a Câmara dos Deputados resgata o corporativismo mais escancarado, agravado pela covardia de uma votação secreta. Na prática, estaríamos diante da constitucionalização da impunidade: crime cometido, autor conhecido, punição nenhuma.
O mais grave é que a aprovação foi esmagadora, com deputados de quase todos os partidos e correntes ideológicas votando a favor. Por isso, a resistência precisa ser ampla e firme. É necessário que todos se manifestem, especialmente os que se dizem defensores da democracia, e ainda mais os que realmente a defendem.
Caetano Veloso, Gilberto Gil, Chico Buarque, Iza, Ivete Sangalo, Anitta, Wagner Moura, José de Abreu, Lázaro Ramos, Camila Pitanga, Luana Piovani, e até o Júnior, deveriam se posicionar. Outros artistas, influenciadores, líderes religiosos, jogadores de futebol, figuras públicas como Popó, João Fonseca, Bia Haddad Maia e a escritora Ana Maria Gonçalves também precisam dizer claramente se apoiam ou não esse retrocesso.
Além disso, como já se pronunciaram antecipadamente em outros casos, os ministros do Supremo Tribunal Federal também têm a responsabilidade de se manifestar sobre a constitucionalidade de um “direito de matar” sem punição que o Congresso Nacional tenta, às pressas, ressuscitar. E, depois de barrar esse abuso, é essencial que a sociedade não se acomode e aproveite o impulso para enfrentar os demais privilégios e excessos, preservando apenas os benefícios compatíveis com uma democracia civilizada.
