O presidente Luiz Inácio Lula da Silva afirmou, nesta quinta-feira (18), que vai vetar o chamado PL da Dosimetria. O texto prevê a redução de penas de condenados pelos atos antidemocráticos de 8 de janeiro de 2023 e pela tentativa de golpe de Estado.
“As pessoas que cometeram crime contra a democracia brasileira terão que pagar pelos atos cometidos contra esse país. Nem terminou o julgamento, ainda tem gente sendo condenada, e o pessoal já resolve diminuir as penas. Eu quero dizer para vocês que, com todo o respeito que eu tenho ao Congresso Nacional, a hora que chegar na minha mesa, eu vetarei. Isso não é segredo para ninguém”, afirmou Lula.
“O Congresso tem o direito de fazer as coisas, eu tenho o meu direito de vetar, depois eles têm o direito de derrubar o meu veto ou não. É assim que é o jogo”, acrescentou, em entrevista à imprensa no Palácio do Planalto.
O presidente argumentou ainda que é preciso “terminar esse processo” e investigar também os financiadores dos atos golpistas. “Nós precisamos levar muito a sério o que aconteceu no dia 8 de janeiro de 2023 e tem gente que quer que a gente esqueça, mas a gente não pode esquecer. Porque se a democracia esquecer da importância que ela tem para uma nação, a gente termina perdendo o jogo”, afirmou.
Nesta quarta-feira (17), em votação nominal, o Senado aprovou o PL da Dosimetria com 48 votos favoráveis e 25 contrários. O projeto agora segue para a sanção presidencial.
Na quarta-feira (17), os senadores aprovaram na Comissão de Constituição e Justiça(CCJ) o parecer do senador Esperidião Amin (PP-SC), que reduz as penas dos condenados por atos golpistas, entre eles, o ex-presidente Jair Bolsonaro.
Amin, que é favorável à anistia, defende que a redução das penas visa “pacificar o país”. Já os opositores do projeto afirmam que ele não representa o anseio do país e foi construído para beneficiar um grupo político que atentou contra a democracia.
O PL da Dosimetria determina que os crimes de tentativa contra o Estado Democrático de Direito e de golpe de Estado, quando praticados no mesmo contexto, implica no uso da pena mais grave em vez da soma de ambas as penas.
O foco do projeto é uma mudança no cálculo das penas, “calibrando a pena mínima e a pena máxima de cada tipo penal, bem como a forma geral de cálculo das penas, reduzindo também o tempo para progressão do regime de prisão fechado para semiaberto ou aberto”.
As mudanças poderão beneficiar réus como o ex-presidente Jair Bolsonaro, além dos militares Almir Garnier, ex-comandante da Marinha; Paulo Sérgio Nogueira, ex-ministro da Defesa; Walter Braga Netto, ex-ministro da Casa Civil; e Augusto Heleno, ex-chefe do Gabinete de Segurança Institucional (GSI).
Nesta quinta-feira, quatro bancadas do PT, PSB, PCdoB e PSOL da Câmara dos Deputados impetraram mandado de segurança junto ao Supremo Tribunal Federal (STF) pedindo a suspensão da tramitação do projeto.
Na manhã desta quinta-feira, Lula recebeu jornalistas para um café da manhã, no Palácio do Planalto, seguido de coletiva de imprensa. Ele está acompanhado dos ministros da Fazenda, Fernando Haddad; da Casa Civil, Rui Costa; das Relações Exteriores, Mauro Vieira; e do Meio Ambiente e Mudança do Clima, Marina Silva.
