A Proposta de Emenda à Constituição (PEC) que dificulta o andamento de processos criminais contra deputados e senadores, incluindo até mesmo a execução de mandados de prisão, foi aprovada na noite desta terça-feira (16) pelo plenário da Câmara dos Deputados, em Brasília, em dois turnos de votação e segue para o Senado.
A proposta de blindagem parlamentar representa um retrocesso institucional e moral que fere os pilares da democracia brasileira. Ao exigir autorização prévia do Congresso para que o Supremo Tribunal Federal processe parlamentares, o projeto cria uma casta política acima da lei, afrontando diretamente o artigo 5º da Constituição Federal, que consagra a igualdade de todos perante a lei.
Mais grave ainda é a previsão de votação secreta para autorizar tais processos, o que viola o princípio da publicidade e da transparência, previsto no artigo 37 da Constituição. A impessoalidade e a moralidade, fundamentos da administração pública, são ignoradas em nome de interesses corporativos.
A sociedade brasileira, já descrente da representatividade política, vê nesse projeto uma tentativa de institucionalizar a impunidade. Em vez de legislar em favor do povo, muitos parlamentares parecem empenhados em proteger seus próprios privilégios. A ampliação do foro privilegiado e a blindagem contra investigações judiciais não fortalecem a democracia — pelo contrário, a corroem.
A lei deve ser aplicada de forma universal. Parlamentares não podem se esconder atrás de prerrogativas para escapar da justiça. A ética e a moralidade no exercício do mandato não são opcionais, são obrigações constitucionais. Blindar políticos de investigações é blindar a corrupção, e isso não pode ser tolerado por uma sociedade que clama por justiça e igualdade.
Políticos corruptos devem ser excluídos da vida pública, não protegidos. Parlamentares que ignoram princípios éticos e morais ao negociar alterações constitucionais para garantir a permanência desses indivíduos na política não merecem respeito nem credibilidade.
Uma ala da PGR (Procuradoria-Geral da República) entende que a chamada PEC da Blindagem é inconstitucional. A avaliação indica que, se a emenda for de fato promulgada, poderá haver contestação junto ao STF (Supremo Tribunal Federal).
A sociedade repele qualquer proposta que crie castas políticas acima da lei. A democracia fortalece-se com responsabilidade, não com blindagem.
