O servidor público federal e vereador piripaense Altamirando – Miranda – da Silva Vieira (Solidariedade), foi alvo de Mandado de Busca e Apreensão na quinta-feira (24), em uma operação realizada pela Delegacia Territorial de Polícia Civil de Piripá. A ação aconteceu em um escritório localizado no centro da cidade, onde o vereador mantém um escritório de Advocacia.
De acordo com a Assessoria de Comunicação Social da 10ª Coordenadoria Regional de Polícia Civil do Interior de Vitória da Conquista, as investigações que resultaram na operação da quinta-feira foram iniciadas após uma denúncia formalizada pela Ordem dos Advogados do Brasil – Subseção de Vitória da Conquista, apontando que o vereador Altamirando – Miranda – da Silva Vieira (Solidariedade) estaria desempenhando atividades jurídicas sem possuir registro profissional.
De acordo com a Assessoria da Polícia Civil, o vereador, estaria valendo-se de sua função pública para atrair clientes e oferecer serviços jurídicos.
No momento em que os Policiais Civis cumpriam o Mandado de Busca e Apreensão, 21 pessoas estavam no escritório aguardando atendimento.
Na operaçã foram apreendidos aparelhos celulares e uma quantidade significativa de documentos, incluindo Procurações já preenchidas e em branco. O material confiscado foi encaminhado ao Departamento de Polícia Técnica para que se realize uma análise detalhada e se identifique a ocorrência de possíveis outros crimes, além do exercício ilegal da Advocacia, atualmente em investigação.
Se ficar comprovado o exercício ilegal da Advocacia, o vereador Altamirando – Miranda – da Silva Vieira, do Solidariedade, pode enfrentar a cassação do seu mandato pelo Legislativo Municipal por quebra de decoro parlamentar. Ele também poderá responder por uma Contravenção Penal, conforme previsto no Artigo 47 do Decreto-Lei nº 3.688/1941 (Lei das Contravenções Penais), que prevê pena de detenção de 15 dias a 3 meses ou multa. Embora não seja considerada um crime, essa infração penal ainda sujeita o vereador a responsabilidade legal.
Além disso, se as investigações conduzidas pela Polícia Civil revelarem que a participação do vereador como falso advogado envolveu a utilização de documentos falsificados, fraudes ou a obtenção de vantagem ilícita em detrimento de terceiros, sua conduta pode ser classificada como crimes previstos no Código Penal. As penas para esses crimes são consideravelmente mais severas. Entre os possíveis delitos, destacam-se:
– Estelionato (Artigo 171 do Código Penal): Refere-se ao ato de enganar alguém para obter vantagem indevida, como a solicitação de valores para atuar em Processos inexistentes. A pena varia de 1 a 5 anos de reclusão, além de multa;
– Falsidade Ideológica (Artigo 299 do Código Penal): Envolve a inserção de informações falsas em documentos públicos ou particulares, como um falso registro na OAB ou Procurações fraudulentas. A pena prevista é de 1 a 3 anos de reclusão, além de multa;
– e Uso de Documento Falso (Artigo 304 do Código Penal): Diz respeito à utilização de documentos falsificados, como Identidades, Certidões ou Processos, para conferir aparência de legitimidade à atuação. A pena, neste caso, também é de 1 a 5 anos de reclusão, além de multa.
As investigações prosseguem para esclarecer a extensão das ações do vereador e a natureza dos possíveis crimes associados.

A reportagem do JS não conseguiu contato com o vereador Altamirando – Miranda – da Silva Vieira (Solidariedade), para oportunizar que pudesse comentar e contraditar as alegações da Subseção Vitória da Conquista da Ordem dos Advogados do Brasil e as conclusões preliminares das investigações da Polícia Civil que justificaram a concessão, pela Justiça, do Mandado de Busca e Apreensão.
A presidência da Câmara Municipal de Piripá também não foi localizada e não emitiu Nota Oficial se posicionando à respeito do ocorrido.
O espaço continua aberto, caso o vereador e a presidência do legislativo Municipal queiram se manifestar.
