O Defensor Público Federal André Naves, Especialista em Direitos Humanos e Inclusão Social, celebrou a aprovação do Projeto de Lei nº 2.628/2022 – Proteção Digital de Crianças e Adolescentes – , aprovada pelo Senado nesta semana. O texto, que agora segue para sanção presidencial, cria um Marco Regulatório para garantir maior segurança no ambiente digital e combater práticas nocivas dirigidas ao público infantojuvenil.
Entre os avanços da nova legislação, Naves destacou a proibição das chamadas “loot boxes”, mecanismos presentes em jogos eletrônicos que simulam apostas ao oferecer recompensas aleatórias mediante pagamento. A prática, comparada a jogos de azar, já foi banida em países como Bélgica e Japão, por expor crianças e adolescentes a riscos psicológicos e sociais.
“O PL 2.628/2022 é uma conquista fundamental para a proteção digital da infância no Brasil. Ele estabelece parâmetros claros para que o ambiente online seja mais seguro e ético. A proibição das loot boxes, em especial, representa um avanço civilizatório: estamos impedindo que crianças sejam expostas a dinâmicas de jogo de azar travestidas de entretenimento. Essa vitória só foi possível graças à mobilização de entidades da sociedade civil, como a Comissão Brasileira Justiça e Paz e a Associação Nacional dos Centros de Defesa da Criança e do Adolescente, que trouxeram dados e argumentos consistentes ao debate parlamentar”, afirmou André Naves.
Além da proibição das loot boxes, a lei aborda questões centrais para a era digital, como: responsabilização das plataformas quanto à exposição de crianças a conteúdos nocivos; regras mais rígidas para publicidade dirigida ao público infantojuvenil; e medidas de prevenção ao aliciamento e à exploração online.
Para Naves, a aprovação do PL nº 2.628/2022 coloca o Brasil em sintonia com países que já avançaram em políticas de proteção digital da infância, tornando-se referência internacional ao conciliar inovação tecnológica com a defesa de direitos fundamentais.
