O Ministério da Fazenda publicou, nesta quarta-feira (1º), no Diário Oficial da União, as regras para impedir o cadastro ou o uso dos sites de apostas, as bets, por beneficiários do Programa Bolsa Família e do Benefício de Prestação Continuada (BPC). Os procedimentos devem ser adotados pelos operadores desses sistemas no prazo de até 30 dias.
A medida cumpre decisão do Supremo Tribunal Federal (STF), que proibiu uso de benefícios sociais para bets.
De acordo com levantamento divulgado em 2024 pelo Banco Central, os beneficiários do Bolsa Família gastaram R$ 3 bilhões em bets em agosto daquele ano, por transferências na modalidade Pix
De acordo com a instrução normativa, os agentes de apostas devem consultar o Sistema de Gestão de Apostas (Sigap) para verificar se o usuário consta da base de dados de beneficiário do Bolsa Família ou do BPC. O sistema do Ministério da Fazenda regula, monitora e fiscaliza o mercado de apostas no Brasil.

As consultas, pelo número do Cadastro de Pessoas Físicas (CPF), devem ser feitas quando o usuário fizer o cadastro no site de apostas e quando efetivar o primeiro login do dia. Além disso, a cada 15 dias, os agentes de bets devem fazer a consulta de todos os usuários cadastrados em seus sistemas de apostas, para identificar aqueles que eventualmente tenham ingressado na base de dados dos programas sociais.
Se a pessoa for beneficiária do Bolsa Família ou BPC, a abertura do cadastro deve ser negada. Caso a identificação ocorra com o primeiro login do dia ou nas consultas regulares, a conta do usuário deve ser encerrada em até 3 dias, contado da data da consulta.
Antes do encerramento, o usuário deve ser comunicado do motivo e informado sobre a retirada voluntária de eventuais recursos disponíveis na conta, no prazo de 2 dias. Caso não seja feita a retirada, o operador de apostas efetuará a devolução do dinheiro em conta cadastrada no site.
No caso de inviabilidade de remessa dos recursos, inclusive em razão de problemas envolvendo a conta do usuário, impossibilidade de contato com ele ou sua recusa em informar uma conta para depósito, em 180 dias os recursos não devolvidos serão revertidos para o Fundo de Financiamento Estudantil (Fies) e o Fundo Nacional para Calamidades Públicas, Proteção e Defesa Civil (Funcap).
O impedimento à utilização de bets será aplicado enquanto o usuário constar como beneficiário dos programas sociais. Ele poderá ser readmitido no sistema de apostas caso seu CPF deixe de constar da base de dados de impedidos do Sigap, desde que não haja outro impedimento legal.
Além dos beneficiários do Bolsa Família e BPC, o cadastro ou uso de sistema de apostas é proibido para:
- menor de 18 anos de idade;
- proprietário, administrador, diretor, pessoa com influência significativa, gerente ou funcionário do agente operador;
- agente público com atribuições diretamente relacionadas à regulação, ao controle e à fiscalização da atividade no âmbito do ente federativo em cujo quadro de pessoal exerça suas competências;
- pessoa que tenha ou possa ter acesso aos sistemas informatizados de loteria de apostas de quota fixa;
- pessoa que tenha ou possa ter qualquer influência no resultado de evento real de temática esportiva objeto de loteria de apostas de quota fixa, como técnicos, árbitros, dirigentes, organizadores de competições e atletas;
- pessoa diagnosticada com ludopatia por laudo de profissional de saúde mental habilitado; e
- pessoas impedidas de apostar por decisão administrativa ou judicial específica, quando formalmente notificadas.
