Advogado e consultor jurídico, Dr. Anselmo Costa Melo entra com ação judicial e representação no Ministério Público contra a OAB após cliente ser vítima de estelionato; sistema eletrônico da Justiça é apontado como porta de entrada para golpistas

A facilidade de acesso a informações públicas em processos judiciais eletrônicos está sendo usada por criminosos para aplicar um novo tipo de fraude, o golpe do falso advogado.
Foi o que aconteceu com o cidadão João (Nome fictício), que perdeu mais de 3 mil reais acreditando estar atendendo a uma solicitação legítima de seu advogado, mas na verdade ele foi induzido a transferir o valor para um golpista através do WhatsApp que usava nome, foto e até o número da OAB do advogado real.
“Não se trata apenas de um golpe isolado, é uma falha sistêmica grave que expõe cidadãos e profissionais a riscos sérios”, afirma o advogado e consultor jurídico Dr. Anselmo Costa Melo, autor da ação judicial e da representação ao Ministério Público Federal.
Como funciona o golpe?
Os estelionatários acessam informações públicas de processos judiciais disponíveis nos sistemas eletrônicos, tendo o nome das partes, dados do processo e, principalmente, o nome e o número de inscrição na OAB do advogado, eles montam um perfil falso em aplicativos de mensagens, como o WhatsApp.
“Com esses dados, eles criam uma narrativa crível, mandam mensagens em tom profissional, usam termos jurídicos e solicitam transferências para supostos custos do processo. As vítimas acreditam porque tudo parece ser mesmo legítimo”, explica Dr. Anselmo Costa Melo.
Representações e pedidos de mudança
Diante do golpe, Dr. Anselmo Costa Melo ingressou com uma ação judicial contra o Conselho Federal da OAB, pedindo indenização por danos morais e alterações nas regras de publicidade dos dados profissionais nos processos eletrônicos.
A ação alega que a exposição do número da OAB nas petições públicas viola a Lei Geral de Proteção de Dados (LGPD) e facilita crimes.
Além disso, protocolou uma representação no Ministério Público Federal, com pedido de inquérito civil e Termo de Ajustamento de Conduta (TAC) contra a OAB. Entre os pedidos estão:
– Suspensão da exigência de exibição pública do número da OAB em petições;
– Restrição ao acesso completo aos dados profissionais dos advogados;
– Campanhas de alerta sobre golpes com falsos advogados;
– Adoção de política de compliance digital para proteger os dados dos inscritos.
“O número da OAB deve ser conferido internamente, com segurança digital, e não ficar escancarado para qualquer um que deseje cometer um crime”, reforça o advogado.
Como se proteger do golpe?
Para evitar cair nesse tipo de golpe, é preciso tomar algumas medidas preventivas de segurança, confira as principais:
1 – Sempre confirmar diretamente com o advogado qualquer solicitação de pagamento, especialmente se feita por aplicativos de mensagem;
2 – Desconfiar de cobranças feitas com excessiva urgência;
3 – Verificar se o número de telefone é de fato o mesmo já utilizado anteriormente pelo profissional;
4 – Em caso de dúvida, ligue ou compareça pessoalmente ao escritório;
5 – Não compartilhe dados sensíveis via mensagens e exija canais oficiais e protegidos para troca de informações processuais.
