Norma estabelece incentivos fiscais e benefícios a empresas e pessoas físicas que invistam em projetos que ajudem a transformar resíduos em novos produtos

OMinistério do Meio Ambiente e Mudança do Clima (MMA) publicou, nesta segunda-feira (16/12), a Portaria GM/MMA nº 1.250/2024, que estabelece as regras para apresentação, análise, aprovação, monitoramento, prestação de contas e avaliação de resultados de projetos relacionados à Lei de Incentivo à Indústria e à Cadeia Produtiva da Reciclagem.
A lei busca fortalecer a reciclagem no Brasil, promovendo a economia circular e incentivando empresas e pessoas físicas a investirem em projetos que ajudem a transformar resíduos em novos produtos. Quem participa como incentivador pode receber benefícios fiscais com dedução no imposto de renda.
Além disso, permite que empresas e organizações apresentem propostas de projetos voltados à reciclagem e à economia circular. Se aprovadas após análise de admissibilidade, podem captar recursos de incentivadores – pessoas físicas ou jurídicas que queiram apoiá-las financeiramente.
Segundo a Portaria GM/MMA nº 1.250/2024, os projetos podem incluir desde ações para fortalecer a participação de catadores de materiais recicláveis até a criação de redes de comercialização e cadeias produtivas no setor da reciclagem. Os objetivos são reduzir resíduos, promover a reutilização de materiais e gerar impacto positivo para o meio ambiente e a sociedade.
A portaria detalha todas as etapas que a serem seguidas pelos proponentes, da apresentação da proposta à execução e prestação de contas do projeto. Reforça também a importância de incluir catadores de materiais recicláveis nas iniciativas e estabelece critérios para o uso dos recursos captados.
Determina, ainda, que os projetos não podem ser usados para cumprir obrigações legais já existentes, como metas de logística reversa, mas devem ir além, trazendo benefícios adicionais para o setor.
Para garantir a transparência, o MMA manterá o site do Sistema Nacional de Informações sobre a Gestão dos Resíduos Sólidos (SINIR) com informações atualizadas sobre a Lei. Além disso, será concedido anualmente um certificado de reconhecimento a incentivadores e beneficiários que se destaquem.
