A Lei 15.077, aprovada em dezembro de 2024, traz novas regras para a concessão do benefício. Entre elas, o novo cálculo da renda familiar e a revisão periódica da situação dos beneficiados

A Lei nº 15.077/2024, que altera as regras do Benefício de Prestação Continuada (BPC) — assistência destinada a idosos a partir de 65 anos em situação de vulnerabilidade e a pessoas com deficiência de baixa renda —, traz mudanças importantes. Uma das principais alterações ajusta a redação da norma para estabelecer que o pagamento do benefício será feito à pessoa idosa ou com deficiência cuja renda mensal bruta familiar, dividida pelo número de integrantes, seja igual ou inferior a um quarto do salário mínimo. Antes da nova Lei, o critério exigia que a renda fosse apenas inferior a esse valor.
Outra mudança foi a definição do que constitui a renda mensal bruta familiar. De acordo com a nova legislação, o valor é descrito como a soma dos rendimentos auferidos mensalmente pelos membros da família, vedadas as deduções não previstas em lei. Para o advogado e especialista em Direito Previdenciário, Washington Barbosa, as mudanças vão impactar de forma negativa os beneficiários do BPC. “Qual é a alteração específica? Se você ganhava um benefício previdenciário, uma aposentadoria de até um salário mínimo, ou então outro BPC, isso não contava na composição da sua renda. Agora, após essa lei do final do ano passado e deste decreto recém-publicado pelo governo federal, o Bolsa Família também vai entrar no cálculo da renda familiar”, explicou Washington Barbosa.
Suspensão do benefício
A nova redação da legislação determina, ainda, que a revisão seja feita periodicamente, sendo que o período anterior de revisão era de dois anos.
Em relação aos requisitos para a manutenção do benefício, a nova redação passou a exigir registro biométrico, além da inscrição no CPF e no Cadastro Único para Programas Sociais do Governo Federal (CadÚnico). O benefício será concedido ou mantido apenas quando o interessado estiver inscrito no CadÚnico, com as informações atualizadas há, no máximo, 24 meses.
“Está se reduzindo despesas no piso da pirâmide. Está se cortando das pessoas que mais precisam. E ao retirar o Bolsa Família, essa pessoa vai ter muita dificuldade. Nós estamos falando em pessoas em estado de vulnerabilidade, qualquer dez reais, qualquer 15 reais, faz muita diferença”, avaliou o jurista. Atualmente, o BPC é pago a cerca de 6,2 milhões de brasileiros. O valor mensal é de R$ 1.518, ou seja, um salário mínimo por beneficiário, sem direito ao 13º salário. Em fevereiro deste ano, o governo federal realizou um pente-fino nos cadastros e cancelou cerca de 34 mil benefícios que apresentavam irregularidades.
