Reconhecimento inclui desfiles, músicas, práticas e tradições

O presidente Luiz Inácio Lula da Silva sancionou, nesta quarta-feira (24), o projeto de lei (PL) que reconhece como manifestação da cultura nacional blocos e bandas de carnaval. O texto do PL nº 3.724/2021 foi aprovado em março pela Comissão de Educação e Cultura do Senado, em decisão terminativa, ou seja, sem votação no plenário da Casa.
Para a relatora do projeto, senadora Augusta Brito (PT-CE), os blocos e bandas de carnaval são manifestações que “refletem a grandeza de nossa diversidade cultural”. Em seu relatório ela citou o Mela-Mela, em cidades do Nordeste, como Beberibe e Camocim, no Ceará; os Caretas, em Guiratinga, no Mato Grosso; e os tradicionais Bate-bolas nos subúrbios cariocas
De acordo com o texto aprovado, o reconhecimento como manifestação da cultura nacional inclui desfiles, músicas, práticas e tradições dos blocos e bandas. O poder público também terá o dever de garantir a livre atividade desses grupos e a realização de seus desfiles carnavalescos.
As escolas de samba já foram reconhecidas como manifestação da cultura nacional, pela Lei 14.567, de 2023.
Trabalhadores em arquivos
Lula também sancionou o projeto que cria medidas especiais de proteção ao trabalho realizado em arquivos, bibliotecas, museus e centros de documentação e memória. O PL nº 5.009/2019, aprovado no início deste mês pelo Senado, altera a Consolidação das Leis do Trabalho (CLT) para prever medidas de saúde e segurança aos trabalhadores nesses ambientes, devido à constante exposição a agentes nocivos causadores de doenças, principalmente respiratórias.
De acordo com a análise da senadora Teresa Leitão (PT-PE), relatora do PL, por ser realizado em ambientes fechados, com pouca ou quase nenhuma exposição solar ou ventilação, a atividade poderá submeter o trabalhador a fatores físicos, como umidade, químicos, como poeira, e biológicos, como bactérias e fungos.
O texto prevê, entretanto, que a caracterização do trabalho realizado nesses ambientes como medida especial de proteção não implicará, de forma automática, sua inclusão no quadro de atividades consideradas insalubres pelo Ministério do Trabalho. Caberá à pasta analisar a oportunidade e a conveniência dessa inclusão a partir da análise das atividades desempenhadas e do ambiente de trabalho dos profissionais da área.
Por sua vez, a caracterização e a classificação de eventual insalubridade somente serão efetivadas a partir de perícia do médico ou engenheiro do trabalho. Por fim, o adicional de remuneração ao trabalhador, decorrentes das condições de insalubridade, será devido apenas a partir da inclusão da respectiva atividade nos quadros aprovados pelo Ministério do Trabalho.
Vale do Panema
O presidente sancionou o PL nº 3.144/2021 que define a região turística Vale do Panema, em São Paulo, como Área Especial de Interesse Turístico. A região, próxima à divisa de São Paulo com o Paraná, compreende o reservatório da Usina Hidrelétrica de Jurumirim e seu entorno, que abrange os municípios paulistas de Piraju, Cerqueira César, Arandu, Tejupá, Avaré, Paranapanema, Itaí, Taquarituba, Itatinga e Angatuba.
O relator do projeto, senador Mecias de Jesus (Republicanos-RR), avaliou que a região cumpre os requisitos para ser considerada uma área especial em razão do turismo náutico e pesqueiro, uma das principais atividades econômicas da região. Ele citou atrativos como a Praia dos Holandeses, a Praia Branca e a Enseada Azul.
As Áreas Especiais de Interesse Turístico são trechos contínuos do território nacional, inclusive suas águas territoriais, a serem preservados e valorizados no sentido cultural e natural, e destinados à realização de planos e projetos de desenvolvimento turístico. O texto foi aprovado no início deste mês no Senado.
