Nova norma exige que organizações implementem medidas voltadas à saúde mental no trabalho. Especialista aponta que a capacitação de gestores pode ser determinante para evitar penalidades e melhorar o ambiente corporativo

| A saúde mental no ambiente de trabalho ganha cada vez mais espaço no debate público e, agora, se torna uma exigência legal. A Lei nº 14.831/2024, que criou o Certificado Empresa Promotora da Saúde Mental, e a atualização da Norma Regulamentadora nº 1 (NR-1), prevista para entrar em vigor em maio de 2025, estabelecem critérios para que empresas monitorem e previnam riscos psicossociais entre os trabalhadores. Quem não cumprir as normas pode ser multado. Se, durante uma fiscalização, o auditor fiscal do trabalho identificar a ausência de medidas voltadas à saúde mental, a empresa pode ser denunciada ao Ministério Público do Trabalho (MPT), que tem autonomia para ajuizar uma ação civil pública e impor sanções financeiras. Além disso, trabalhadores podem levar suas queixas diretamente ao MPT, que costuma abrir investigações nesses casos. Diante desse cenário, muitas empresas têm adotado um caminho preventivo: investir na capacitação de líderes e equipes em comunicação assertiva e oratória. A justificativa para essa estratégia está nos impactos diretos da comunicação no bem-estar dos colaboradores. Segundo a fonoaudióloga e doutora em expressividade Cristiane Romano, “a forma como os gestores se comunicam influencia diretamente a saúde mental da equipe. Uma comunicação falha pode gerar estresse, insegurança e até afastamentos, enquanto um diálogo estruturado e empático pode prevenir conflitos e melhorar a convivência no ambiente profissional.” Adequação ao novo cenário A mudança na legislação não apenas impõe novas regras, mas exige uma transformação na cultura organizacional. Entre as medidas que as empresas podem adotar, a especialista aponta: Treinamentos para comunicação assertiva: capacitar gestores e equipes para expressarem suas ideias de maneira clara e respeitosa, evitando ruídos e desgastes desnecessários. Programas de oratória: estimular líderes a melhorarem sua expressividade e segurança ao se comunicar, aumentando a confiança e a clareza nas interações diárias. Apoio psicológico estruturado: criar canais internos para suporte emocional, como programas de escuta ativa e sessões de aconselhamento para os colaboradores. Avaliação contínua do ambiente corporativo: realizar pesquisas de clima organizacional e ouvir os funcionários para identificar possíveis problemas antes que se agravem. Empresas que já adotaram essas práticas relatam melhora no engajamento e na produtividade das equipes. Segundo Romano, a antecipação à legislação traz benefícios que vão além da conformidade legal. “A comunicação bem trabalhada dentro das empresas não apenas previne penalidades, mas melhora as relações interpessoais e cria um ambiente mais saudável e produtivo”, afirma a especialista. Impacto na imagem corporativa Além das sanções legais, o descumprimento das normas pode afetar a reputação das empresas. Organizações que ignoram a saúde mental no trabalho correm o risco de crises institucionais, perda de talentos e baixa atração de novos profissionais. Em contrapartida, aquelas que adotam boas práticas de comunicação e bem-estar são vistas com maior credibilidade pelo mercado e pelos consumidores. “Investir na capacitação comunicativa dos líderes não é mais um diferencial, é uma necessidade”, conclui Romano. “As empresas que entenderem isso primeiro sairão na frente, tanto no cumprimento da lei quanto na construção de um ambiente corporativo sustentável e humano.” |
