Ministro atende a pedido feito pela Advocacia-Geral da União

O ministro Dias Toffoli, do Supremo Tribunal Federal (STF), decidiu nesta terça-feira (17) suspender a prescrição de ações judiciais indenizatórias que envolvem o ressarcimento dos descontos irregulares nos benefícios de aposentados e pensionistas do Instituto Nacional do Seguro Social (INSS).
O ministro atendeu ao pedido feito pela Advocacia-Geral da União (AGU). Segundo Toffoli, a suspensão da prescrição vai permitir a manutenção da segurança jurídica, evitar a advocacia predatória, proteger o patrimônio estatal e garantir os direitos dos aposentados.
Na mesma decisão, Toffoli decidiu marcar uma audiência de conciliação no STF para tratar dos Processos sobre o Ressarcimento dos Aposentados. A reunião será realizada na terça-feira (24) e contará com a presença de representantes da União, do INSS, da Defensoria Pública da União (DPU) e do Ministério Público Federal (MPF).
O ministro deixou de avaliar pedido da AGU para abertura de crédito extraordinário no orçamento para viabilizar o ressarcimento e a exclusão dos valores do teto de gastos da União para os anos de 2025 e 2026. A suspensão nacional das Ações que tratam do pagamento também não foi analisada.
Segundo Toffoli, os Requerimentos serão analisados no decorrer da tramitação da Ação que trata da questão no Supremo.
De acordo com dados do Conselho Nacional de Justiça (CNJ), cerca de 4 milhões de Ações sobre assunto estão em tramitação no país.
Bloqueios
Até o momento, a Justiça Federal já bloqueou R$ 2,8 bilhões em bens de empresas e investigados envolvidos nas fraudes em descontos irregulares nos benefícios.
As fraudes são investigadas na Operação Sem Desconto, da Polícia Federal, que apura um esquema nacional de descontos de mensalidades associativas não autorizadas. Estima-se que cerca de R$ 6,3 bilhões foram descontados de aposentados e pensionistas entre 2019 e 2024.
