Em 14 municípios a eleição está sub judice e, em três, foi anulada

Os prefeitos e vereadores eleitos em outubro de 2024 tomam posse nos respectivos cargos nesta quarta-feira, 1º de janeiro de 2025.
De acordo com a página de estatísticas do Tribunal Superior Eleitoral (TSE), serão 5.543 prefeitos, 5.543 vice-prefeitos e 58.072 vereadores empossados para mandatos de quatro anos.
Do total de 5.543 prefeitos e vice-prefeitos que tomam posse, 2.466 foram candidatos reeleitos e os demais (3.077) estão no primeiro mandato como chefe do poder Executivo local.
Nesta segunda-feira (30), a base de dados do TSE registrava outros 14 municípios com o resultado da eleição sub judice e outras três com status de anulada. Em nota à Agência Brasil, o TSE afirma que “estes dados são atualizados diariamente e podem mudar a depender do resultado processual e da publicação das atualizações.”
Vale lembrar, ainda, que não há posse no Distrito Federal porque a unidade federativa não tem eleições municipais. A Constituição Federal de 1988 proíbe a divisão do DF em municípios.
Responsabilidades de prefeitos
A prefeita ou o prefeito empossado é o chefe do Poder Executivo municipal, portanto, responsável pela gestão do município. O mandato de prefeito dura quatro anos, com possibilidade de uma reeleição por mais quatro.
Nesse período, os ocupantes dos cargos devem gerenciar os recursos financeiros do município (arrecadar, administrar e aplicar os impostos da melhor forma); planejar e realizar melhorias locais, desenvolver as funções sociais da cidade e garantir o bem-estar de seus habitantes; intermediar politicamente junto a outras esferas do poder, sempre com o intuito de beneficiar a população local, entre outras funções que promovam o desenvolvimento local.
O presidente da Confederação Nacional de Municípios (CNM), Paulo Ziulkoski, destaca quais devem ser as prioridades no exercício da função pública. “É preciso honrar o mandato que a população vos deu nas urnas, enfrentar as dificuldades e sempre conduzir a administração sob um modelo de governança pública que coloque em primeiro lugar as reais necessidades da comunidade.” Ziulkoski frisa aos gestores municipais que é importante esquecer os embates ideológicos da eleição. “Governar para todos e com todos que queiram ajudar o seu município a progredir.”
Responsabilidades de vereadores
Já os mandatos de vereadoras e vereadores, também com duração de quatro anos, não têm uma quantidade definida de possibilidades de reeleição. Esse grupo de parlamentares atua nas câmaras municipais, também chamadas de câmara de vereadores. O total de vagas para cada câmara depende do número de habitantes do município, segundo o inciso IV do artigo 29 da Constituição Federal.
As funções no poder Legislativo municipal estão subdivididas em quatro atribuições principais:
· legislativa: proposição, análise, discussão e votação de leis municipais e gestão de alguns impostos;
· fiscalizadora das ações da administração municipal no cumprimento das leis e do orçamento público;
· assessoramento ao Executivo: apoio e discussão acerca de políticas públicas a serem implantadas por meio do Plano Plurianual, da Lei Orçamentária Anual (LOA) e da Lei de Diretrizes Orçamentárias (LDO).
· julgadora: apreciação das contas públicas de administradores e apuração de infrações político-administrativas cometidas por prefeito e pelos próprios vereadores.
Calendário
A justiça eleitoral nos estados realizou até 19 de dezembro cerimônias de diplomação dos eleitos para os cargos de prefeito, vice-prefeito e vereadores. Os atos solenes marcaram o fim do processo eleitoral de 2024 e habilitou eleitos e eleitas a assumirem e exercerem seus mandatos a partir do primeiro dia de 2025, por quatro anos.
As cerimônias ocorrem em todo o país no dia 1º de janeiro do ano subsequente ao da eleição, conforme determina a Constituição Federal de 1988, no capítulo IV, no inciso III, que trata dos municípios.
Porém, somente para os cargos de presidente da República, vice-presidente, além de governadores e vice-governadores, a data de posse será alterada a partir de 2027, conforme a Emenda Constitucional 111/2021. Essas alterações na data de posse não incluem prefeitos.
Os próximos presidente e vice-presidente da República assumirão o cargo no dia 5 de janeiro de 2027, enquanto governadores e vice-governadores iniciarão o mandato no dia 6 de janeiro. As alterações serão aplicadas somente a partir das eleições de 2026.
Antes da atual Constituição Federal, o presidente e os governadores eram empossados em 15 de março.
