O sistema do Cadastro Nacional de Animais Domésticos já está em fase final de teste e deve entrar em funcionamento em breve para que os tutores possam registrar seus bichos de estimação e emitir, gratuitamente, o RG Animal. De acordo com o Ministério do Meio Ambiente (MMA), a ferramenta poderá ser acessada pela conta Gov.br, o portal de serviços do governo federal.
Organizações de resgate de animais e prefeituras também poderão cadastrar os bichos sob sua responsabilidade e emitir a carteirinha de identificação, que incluirá um código de identificação (QR Code). Esse código poderá ser fixado na coleira do animal, permitindo que, via câmera do celular, qualquer pessoa consiga localizar o tutor.
A Lei 15.046/2024, aprovada em novembro pelo Congresso e sancionada pelo presidente Luiz Inácio Lula da Silva no último dia 18, autorizou a criação do cadastro pela União. O sistema vai reunir informações sobre os proprietários e os pets, para facilitar o controle de zoonoses e o combate a abandono e maus-tratos de animais. A medida também deve proporcionar mais segurança em transações de compra e venda.
De acordo com a nova lei, o cadastro deve conter identidade, CPF e endereço do proprietário e dados sobre a procedência e características dos animais: raça, sexo, idade real ou presumida, vacinas aplicadas e as doenças contraídas ou em tratamento, além do local onde o animal é mantido. Será dever dos tutores informar sobre a venda, doação ou morte do bicho de estimação, apontando a causa.
Cadastro deve conter identidade, CPF e endereço do proprietário – Rovena Rosa/Agência Brasil
Caso o animal utilize um microchip subcutâneo que o identifique, o dispositivo poderá ser incluído no cadastro. “Salvo nos casos em que o procedimento for custeado pelo governo federal, a microchipagem não será obrigatória. No entanto, é recomendada como forma de aumentar a segurança e o controle dos animais”, esclareceu o MMA.
O microchip é um dispositivo colocado por veterinários sob a pele dos animais, com um código associado aos dados do proprietário. Para acessar as informações, entretanto, é necessário utilizar um leitor adequado, normalmente disponível em clínicas veterinárias que fazem o procedimento.
Políticas públicas
O cadastro dos animais será realizado prioritariamente pelos tutores responsáveis, no entanto, organizações não-governamentais (OGNs), prefeituras e o Distrito Federal poderão cadastrar animais sob sua guarda, incluindo aqueles que se encontram em abrigos, canis, centros de zoonoses ou em situação de rua. Quando esses animais forem adotados, será feita, pelo sistema, a transferência da tutela.
Além disso, segundo o MMA, municípios e estados que aderirem ao sistema terão acesso a uma área específica, onde poderão visualizar e analisar dados estatísticos regionais. “Essas informações são essenciais para a gestão de programas locais de proteção e manejo populacional ético de cães e gatos, incluindo ações como vacinação, mutirões de castração e microchipagem, campanhas de adoção, entre outros”, destacou a pasta.
O cadastro será acessível ao público via internet e a fiscalização e centralização dos dados será feita pelos estados e pela União. Atualmente, iniciativas semelhantes já existem no país, mas de forma descentralizada.
Os animais voltados à produção agropecuária, para produtos ou serviços, não precisarão ser cadastrados. A lei trata apenas de animais que se destinam à companhia ou são criados como de estimação.
Imposto
Após a aprovação do projeto do Senado, surgiram especulação sobre a possibilidade de criação de imposto a ser pago por quem é dono de animal doméstico, como ocorre em outros países, como a Alemanha. A nova lei, entretanto, não prevê pagamento de nenhum tipo de taxação, apenas autoriza a criação do cadastro, que será gratuito.
“No Brasil, o objetivo é melhorar a gestão e o planejamento de ações, sem impor sanções ou cobranças. O acesso público aos dados será limitado ao necessário para dar suporte a políticas públicas, com garantia de privacidade e proteção dos dados pessoais”, destacou o governo federal, em comunicado.
