Mais de 4,5 mil crianças foram registradas sem o nome do pai no primeiro semestre deste ano na Bahia. Em 2024, o número chegou a 12.436. Para combater o cenário de ausência paterna apontado pela Associação dos Registradores Civis das Pessoas Naturais do Brasil (Arpen Brasil), a Defensoria Pública da Bahia (DPE/BA) vai intensificar as ações para reconhecimento de paternidade com mutirões de atendimentos nas cidades de Anagé, Itapetinga e Vitória da Conquista.
Durante as ações, a Defensoria vai atender, sem necessidade de agendamento, demandas de exames de DNA, reconhecimento voluntário de paternidade biológica e socioafetiva e fazer atendimentos iniciais para averiguação de paternidade. Em Anagé, o mutirão acontece no próximo dia 27, das 9h às 13h, no Cras (Centro de Referência em Assistência Social). No dia 29, a ação acontece em Itapetinga, na sede da DPE/BA, das 8h às 14h; e em Vitória da Conquista, das 09 às 13h, no Centro Cultural Glauber Rocha.
Os mutirões fazem parte da campanha Meu Pai Tem Nome, promovida pelo Conselho Nacional das Defensoras e Defensores Públicos-Gerais (Condege), que tem como objetivo reduzir o número de casos de filhos e filhas com pais ausentes. Em decorrência da campanha, a Defensoria Pública dos Estados e do Distrito Federal promove com uma programação voltada à efetivação do direito fundamental de filiação.
De acordo com a Coordenadora da 2ª Regional da DPE/BA, Ana Luíza Brito, a meta é reduzir ao máximo o número de crianças sem nome do pai na Certidão de Nascimento. Nesse sentido, a Defensoria tem fortalecido o diálogo e parceria com os Cartórios locais, Conselhos Tutelares, Instituições de Acolhimentos e Secretarias Municipais para divulgação dos serviços.
Ter o nome do pai na Certidão de Nascimento é um direito garantido na Constituição Federal e no Estatuto da Criança e do Adolescente. O Registro assegura o recebimento de pensão alimentícia, regulamentação de convivência e direitos sucessórios (herança). Garantir o nome do pai nos documentos também pode evitar constrangimentos e barreiras emocionais em crianças, adolescentes e até mesmo adultos.
Além do reconhecimento de paternidade decorrente dos testes positivos de DNA, também pode ser realizado, através da DPE/BA, o reconhecimento socioafetivo, que independe de laço sanguíneo. Previsto no Provimento 63 do Conselho Nacional de Justiça (CNJ), ele permite o reconhecimento voluntário da paternidade/maternidade, desde que exista uma relação de afeto estabelecida pela convivência, exercendo os direitos e deveres inerentes à posição paterna ou materna.
A Defensoria da Bahia atua pelas vias judiciais e extrajudiciais para garantir o reconhecimento de paternidade e os direitos decorrentes. No primeiro semestre deste ano, foram feitos mais de 800 exames de DNA e cerca de 440 reconhecimentos de paternidade. Em 2024, foram mais de 2 mil testes. Os serviços estão disponíveis na capital, em todas as Unidades do interior e nas itinerâncias realizadas pela Unidade Móvel de Atendimento.
Defensoria precisa saber
Na Bahia, os registros de crianças sem nome do pai devem ser notificados pelos Cartórios de todo o Estado à Defensoria. A exigência é prevista na Lei Estadual 13.577/2016, que visa facilitar o acesso da Instituição às informações necessárias para a investigação de paternidade. Os dados devem ser enviados mensalmente inclusive pelos Cartórios de Registro Civil das cidades que não possuem sede da DPE/BA instalada. Somente no primeiro semestre, a DPE/BA recebeu mais de 2,2 mil notificações desta natureza.
