Nesta segunda-feira, 6 de abril, o presidente do Tribunal de Justiça do Estado da Bahia (TJ-BA), desembargador Lourival Almeida Trindade, decidiu por suspender a liminar proferida pela 7ª Vara da Fazenda Pública de Salvador, que impedia a Empresa Baiana de Águas e Saneamento S/A (Embasa) de cortar o fornecimento de água de inadimplentes por 90 dias, em decorrência da crise provocada pela pandemia do Coronavírus, e fixava multa diária de R$ 50 mil em caso de descumprimento, até o limite de R$ 1 milhão, a ser revertida para o Estado da Bahia.
De acordo com comunicado divulgado pela Assessoria de Comunicação Social do Tribunal de Justiça do Estado da Bahia (TJ-BA), com a medida, o presidente Lourival Almeida busca evitar o aprofundamento da crise econômica que se agrava por conta da Covid-19. O comunicado diz ainda que a liminar proferida pela 7ª Vara da Fazenda Pública de Salvador colocava no mesmo patamar as pessoas de baixa renda, beneficiários da tarifa social de água, e aqueles que tem renda suficiente para pagar a conta, o que estaria causando um prejuízo significativo aos cofres estaduais.
Segundo o presidente Lourival Almeida Trindade, a liminar teve o desiderato de fazer um balanceamento entre os consumidores de baixa renda, inscritos na tarifa social de água, e aqueles que mesmo neste período de pandemia, causada pelo Coronavírus, podem pagar pelo consumo de água.
Na ação ajuizada pelo Consórcio Intermunicipal Somar foi concedida medida liminar pelo juiz Glauco Dainese de Campos, determinando que a Empresa Baiana de Água e Saneamento S/A (Embasa) se abstivesse de suspender o fornecimento de água e dos demais serviços que presta à população de todo o Estado da Bahia pelo período de 90 dias. O juiz da 7ª Vara da Fazenda Pública de Salvador determinou ainda o religamento das faturas que já estivessem em atraso e já tinham tido o serviço suspenso, independentemente de pagamento no prazo de até 15 dias.
Em sede de recurso, o Estado da Bahia pleiteou a suspensão de medida liminar, alegando que a medida, por não direcionar exatamente a proibição para quem de fato necessita de incentivos e subsídios, poderia criar um grande problema para os cofres públicos, principalmente quando é preciso de recursos para enfrentar a pandemia do Coronavírus. O Estado da Bahia argumentou ainda que já adotou com a Embasa medidas para proteger a população mais carente nesse período.
Por meio da Assessoria de Comunicação Social, o presidente do TJ-BA enfatizou que as medidas adotadas administrativamente entre o Governo do Estado da Bahia e a Embasa são plausíveis e devem garantir a manutenção do serviço para a população carente durante o enfrentamento da Covid-19, sobretudo, para os cidadãos inscritos no programa “Tarifa Social”. O desembargador Lourival Almeida Trindade também considerou que a medida não afeta o acordo administrativo realizado entre o Governo do Estado e a Embasa.
De acordo com a Assessoria de Comunicação Social do Tribunal de Justiça do Estado da Bahia, a urgência na concessão da medida evita um prejuízo à Embasa estimado em R$ 55 milhões, o que comprometeria a continuidade da prestação dos serviços essenciais de fornecimento de água e saneamento básico na Bahia.
