O ministro da Justiça e Segurança Pública, Ricardo Lewandowski, disse nesta segunda-feira (10) que a proposta de emenda à Constituição da Segurança Pública (PEC) que será enviada ao Congresso Nacional, vai incorporar o entendimento do Supremo Tribunal Federal (STF) sobre as guardas municipais. 
Em decisão no final de fevereiro, a Corte confirmou que as guardas municipais podem fazer policiamento ostensivo nas vias públicas, respeitando-se os limites de competências com as demais forças de segurança.
“Essa tese do Supremo foi incorporada à PEC. A PEC hoje tem a integração de todas as polícias brasileiras, desde a Polícia Federal até a Guarda Municipal, na base do sistema”, explicou o ministro em conversa com jornalistas no Palácio do Planalto.
Lewandowski disse que o texto está em análise na Casa Civil, e que deve ser enviado, em breve, ao Congresso Nacional, mas não deu uma data para o envio.
O que muda
A PEC da Segurança Pública altera a redação dos artigos 21, 22, 23 e 24 da Constituição Federal, que tratam das competências da União, privativas ou em comum com os estados, municípios e o Distrito Federal, e muda o Artigo 144, sobre os órgãos que cuidam da segurança pública em todo o país.
Com a proposta, o governo federal pretende dar status constitucional ao Sistema Único de Segurança Pública (Susp), criado por lei ordinária em 2018 (Lei 13.675), e levar para a Constituição Federal a previsão do Fundo Nacional de Segurança Pública e do Fundo Penitenciário, que atualmente estão estabelecidos em leis próprias.
O texto da PEC também aumenta as atribuições da Polícia Federal (PF) e da Polícia Rodoviária Federal (PRF), que passaria a ser chamar Polícia Viária Federal, abrangendo o patrulhamento ostensivo das rodovias, ferrovias e hidrovias federais.
