Em decisão do último dia 30 de setembro, o Tribunal Regional Eleitoral da Bahia (TRE), por seis votos a um, reformou a sentença do Juiz Paulo Rodrigo Pantusa, titular da 113ª Zona Eleitoral, que atendeu a Ação de Impugnação de Registro de Candidatura protocolado pela Coligação “Juntos a Gente Transforma!”, INDEFERINDO O Registro da Candidatura do ex-prefeito Alan Antônio Vieira (MDB) à sucessão municipal de Riacho de Santana.
A decisão do Colegiado representou uma reviravolta significativa no cenário político local, especialmente considerando que o ex-prefeito tem capital político para tornar a disputa acirrada para a sucessão municipal de Riacho de Santana, além de desmontar um discurso que vinha sendo explorado pelo grupo situacionista.
O ex-prefeito Alan Antônio Vieira (MDB) tinha seus direitos políticos questionados em virtude da decisão do Legislativo Municipal que validou Parecer Prévio do Tribunal de Contas dos Municípios recomendando a rejeição das contas do exercício de 2018, tendo como argumento a inobservância do limite prudencial de despesas com pessoal previsto na Lei Complementar 101/00 (Lei de Responsabilidade Fiscal).
No julgamento da Ação de Impugnação de Registro de Candidatura proposto pela Coligação do candidato situacionista, o Juiz Eleitoral da 113ª Zona Eleitoral, considerou que a irregularidade apontada pela Corte de Contas e ratificada pelo Legislativo Municipal configurava Ato de Improbidade Administrativa, sem levar em conta que não teria havido, como prevê deva ser a legislação vigente (Lei Federal 14.230/2021), dolo, mas imprudência ou negligência. No entanto, após a análise dos argumentos apresentados pela defesa do ex-prefeito, o Tribunal Regional Eleitoral da Bahia entendeu que não teria havido a afronta grave ao dispositivo legal vigente, permitindo assim a recuperação da elegibilidade do candidato.
A maioria do Colegiado Regional Eleitoral entendeu que a democracia se fortalece com a participação de todos os cidadãos aptos a concorrer aos cargos eletivos, desde que cumpram os requisitos legais.
A decisão foi recebida com reações diversas. O ex-prefeito e seus apoiadores celebraram a notícia, afirmando que Alan Antônio Vieira está preparado para retomar a gestão e trazer melhorias para o município. Por outro lado, opositores manifestaram preocupação, argumentando que a sua candidatura pode ser um retrocesso para a política local, insistindo na tese da reprovação das contas do exercício de 2018.
Com a definição do Tribunal Regional Eleitoral, o ex-prefeito Alan Antônio Vieira (MDB) está oficialmente apto a participar da disputa eleitoral que estão marcadas para este domingo, 6 de outubro, e a expectativa é de que a disputa se intensifique nas próximas horas, com debates acalorados sobre propostas e projetos para o futuro da cidade.
O caso do ex-prefeito e candidato à sucessão municipal de Riacho de Santana destaca a complexidade do Sistema Eleitoral brasileiro e a importância da atuação do Judiciário na regularização das candidaturas, garantindo que todos os cidadãos tenham o direito de participar do processo democrático.
